If something happens, get an attorney. Don’t try to smooth things over yourself. People who do that still go to jail. If you find yourself in this situation, have been arrested, or need an attorney give me a call.

Oklahoma County Sheriff’s Office: “We have no plan to remove ICE from the jail’

“When ICE identifies an individual they want to further investigate, ICE will issue a detainer requesting a hold for that individual for up to 48 hours . . . . These detainers have been subject to several legal challenges with different jurisdictions finding the practice of honoring the detainers to be unconstitutional. . . . ICE detainers are requests, not mandatory warrants signed by a judge and they are not a legally enforceable mandate. This is the position adopted by ICE. Since the detainers are not mandatory, any choice made to honor them brings along the possibility of civil liability if the detainer is found to be unconstitutional.”

I’ve been fighting for the constitution for years. Finally it feels like somebody is listening. A constitutional requires a warrant, signed by a judge(or magistrate). “ICE holds are requests”. No judge is involved. Tbh, Oklahoma County is not the first county to recognize the unconstitutionality of ICE detainers. Earlier this year we a Garfield County judge found the constitution mattered more than the happenstance of birth. He ordered the jail to release our client immediately and to ignore the ICE detainer. The fight is not over, but we are gaining ground.

No matter how bleak it seeks you don’t have to be afraid. We are all given a right to freedom. God bless America and the constitution!
