Tip Tuesday: Slip-and-Fall Accidents Involving Transient Conditions

A transient condition is a temporary hazard that comes and goes, such as water, oil, or another slippery substance on the floor.

Many people assume that slipping on a hazardous condition automatically means they have a case, but that is not always true.

Watch Bill’s video as he explains what you must prove in a slip-and-fall case involving a transient condition.

Generally, you must establish that the property owner had notice of the hazard. This may be proven by showing that:

- Someone reported the condition, but the owner failed to address it; or
- The condition existed long enough that the owner should have discovered and corrected it.

If you are injured after slipping on water, oil, or another temporary hazard, speak with a personal injury attorney as soon as possible. An attorney can investigate whether the property owner had notice of the condition and determine whether you may be entitled to compensation.

Tip Tuesday: Take Photos of Your Injuries

One of the simplest things you can do to help document your personal injury case is to take photographs of your injuries.

Watch Bill explain why these photos can become powerful evidence.

Start taking pictures immediately after the accident. Photograph every visible injury, including cuts, bruises, swelling, scrapes, and stitches. Continue taking photos regularly during the first week or two because injuries often change over time. Bruising, for example, may look worse on the second or third day than it did immediately after the accident.

Make sure the photos are clear and well-lit. Take close-up pictures of each injury, as well as wider shots that show where the injury is located on your body.

If you are required to use a brace, sling, crutches, wheelchair, or another medical device, take photographs of yourself using it.

These photos can help a jury understand what you experienced in a way that words and medical records alone may not fully capture.

Remember: Continue seeking medical treatment and save your original, unedited photographs.

Tip Tuesday: Think Before You Post After an Accident

After an accident, your first instinct might be to post on social media. Don’t.

Insurance companies and defense attorneys often review your social media accounts and look for anything they can use against you.

A photo of you smiling at a family gathering? They may argue you are not really hurt.

A post saying “I’m okay” after the accident? They may use it to minimize your injuries.

Even check-ins at restaurants, stores, or events can be used to track your activities and contradict your claims about pain or physical limitations.

Watch Bill explain why what you share online can hurt your case.

His advice: Do not post anything about the accident. Set your accounts to private and avoid posting until your case is resolved.

Tip Tuesday: July 4th Safety

The Fourth of July is one of Bill’s favorite holidays. If you’re like him, you’ll be spending the day grilling with family and friends and enjoying the summer weather.

But it’s also one of the busiest holidays for emergency rooms. Watch Bill share a few simple tips to help keep you safe this Independence Day:

Fireworks: Leave them to the professionals. Consumer fireworks are illegal in many areas.

Grilling: Keep your grill a safe distance away from your home, deck, and anything flammable. Never leave it unattended, and make sure it’s completely extinguished before the evening ends.

Alcohol: If you’re drinking, don’t drive. Have a plan and a safe ride home before the celebrations begin.
