💸ICYMI: we’re revisiting the August 26 DOJ blockbuster settlement under which Villages Health System agreed to pay $541.5 million, forcing it into Chapter 11 bankruptcy. The massive payout settled allegations that the Florida-based healthcare provider group violated the False Claims Act by causing the submission of false diagnosis codes to increase their payments under the Medicare Advantage program.

It is just the latest in an ongoing string of False Claims Act settlements involving alleged fraud on the Medicare Advantage program (also known as risk adjustment fraud).

🗣️We’re circling back to a notable settlement from the end of the summer. On August 24, the DOJ announced that Tetra Tech paid $57 million to resolve False Claims Act allegations that it fabricated work and falsified data under a Navy contract relating to assessing and remediating radiation at the former Hunters Point Naval Shipyard.

The settlement is significant because it is another example of this Administration’s willingness to use the False Claims Act to address a wide array of fraud. In this case, even in the area of environmental harm, an area where the government has significantly tamped down its regulatory rigor.

Like most False Claims Act cases, this case was originated by whistleblowers -- former Tetra Tech employees and contractors. They will collectively receive an award of roughly $12 million from the proceeds of the government’s recovery.

💻🔒 Honeywell Aerospace, Inc., a company offering aerospace products and solutions to commercial and customers, agreed to pay over $2 million to resolve False Claims Act claims related to allegedly failing to comply with applicable cybersecurity requirements.

This case was initiated by a whistleblower, a former employee, who will receive a share of the recovery.

According to whistleblower attorney Dan Noel: “This settlement emphasizes the importance of following applicable cybersecurity requirements in defense contracts. Government contractors must comply with those requirements to protect sensitive government data and national security.”

“Whistleblowers play a key role in alerting the government to cybersecurity vulnerabilities and ensuring that government contractors do not ignore these critical safeguards,” Noel added.

⚖️The DOJ recently announced that a jury convicted Sioux Erosion Control Inc., its part-owner and vice president, and an employee for participating in antitrust conspiracies targeting over $100 million in publicly funded transportation construction contracts.

Price-fixing, bid-rigging, or allocation agreements between competitors are per se violations of Section 1 of the Sherman Act and among the types of antitrust violations that are eligible for whistleblower awards under the DOJ Antitrust Whistleblower Rewards Program. 💸In August, FinCEN hit UBS Financial Services with the largest-ever Bank Secrecy Act violation penalty against a broker-dealer after finding that roughly 50,000 foreign-currency wires totaling more than $10 billion went unmonitored. UBS will pay $125M to settle FinCEN’s charges.

FinCEN’s messaging is clear: BSA violations can bring serious consequences. And whistleblowers are continuously encouraged to speak up.

Under FinCEN’s program, individuals who provide information leading to an enforcement action may be eligible for up to 30% of the government’s recovery. With FinCEN moving toward finalizing its whistleblower rules, the agency appears increasingly poised to begin issuing awards.
