Several new clients have come to me after receiving collection judgements from the City for unpaid fines. The twist: at least three of the client owe less than $7,000 in total for a few summonses. On August 9, 2025 owners/property managers of buildings constructed before 1-1-60 or between that date and 1-1-78 where they know there is lead-based paint are required to perform XRF tests on all apartments and common spaces or sooner if a child under 6 years old lives there or if ordered by a City agency.

The City is planning more fines for property owners! To beautify the City for tourists (per the Mayor) there are proposals to introduce new Codes and Rules that would fine any property owner with a sidewalk shed (commonly but mistakenly called "scaffolding") not used for a new building or demolition still at the building after 90 days. Fines could reach up to $6,000 a month. The supporters of these measures claim that property owners who need to repair the building's exterior simply install a shed and never make the repairs. I have many clients whose facade repairs take much longer than 90 days, especially during the fall or winter when it is impossible to make such repairs. Your thoughts? Local Law 77 of 2023, enacted June 11, 2023, amends NYC Administrative Code ยง 28-207.4.2 to allow the DOB to file a vacate order with the county clerk and posted on the DOB's website. Posting on the website serves as legal notice to the owner of the vacate order.

A reminder that Local Law 31 of 2000 requires that every owner of a building built before 1960 or built between 1960 and 1978 and has actual knowledge of lead-based paint in the premises must hire an EPA-certified inspector or risk assessor, independent of the owner or any other firm hired to perform lead-based paint remediation, to test for the presence of lead-based paint by August 9, 2025. This testing must be completed within one year if a child under the age of 6 routinely spends 10 or more hours per week in the apartment. One of the best things a New York City property owner can do is have a current HPD registration listing an address where mail is safely delivered to you and where you have regular access to that mail. Too many clients list addresses with poor mail delivery or where they seldom visit. The result: defaulted summonses, missed required inspections, and delayed City permissions. If not registered with HPD, make sure the address listed with the Dept of Finance for delivery of the property tax bill is similarly good for the owner.

All buildings with one or more drinking water tank used to store potable water were supposed to file their annual water tank inspection by January 15. If you haven't had the potable water tank at your building tested, haven't filed the inspection report, or aren't sure there is a potable water tank at your building, contact my office and we can assist you.

One alarming factor in the publication by the New York City's Public Advocate of the property owners he calls the "100 worst" is the steep increase in the issuance of HPD violations from last year to this year. It is important to remember that the list is based on HPD violations that have not been certified as corrected only. HPD allows a short period during which an owner or managing agent can certify correction. If you have any questions or concerns about resolving HPD violations, please contact me.

The FDNY has issued a bulletin on E-Bikes which must be posted in buildings and distributed to residents no later than April 30, 2023. The bulletin must also be distributed to building employees and with new and renewed leases. Contact me with any questions of for a copy of the bulletin.

On November 22, 2022 Governor Hochul signed New York State Senate bill S02012A into law, prohibiting property owners from charging a monthly $5 from tenants who pay their own electricity bill and install their own air conditioner. The law went into effect immediately. If you have any questions, please contact me.

HPD recently posted a new list of 1,163 properties now included in the CONH [Certificate of No Harassment] pilot program. Many properties are on the list simply for having "too many" HPD violations without any finding of past tenant harassment.
