After I defeated the People's Motion to Stay the trial until their appeal his heard, and determined, there is now a new trial date set for SEptember 25, 2023. Co-Counsel Mark Fonte and I are gearing up for this new trial and we are ready to go.

A Staten Island man was freed early after spending several years behind bars for a robbery he says he did not commit. In March, his case was vacated by a judge, though the district attorney's office is still reviewing it. CBS2's Natalie Duddridge spoke with him after he reunited with his family.

Timothy Turner is expected to be released from prison on Monday.

Decision is in. Conviction and sentence vacated and new trial ordered. While we didn't get Actual Innocence we did accomplish an extremely rare reversal of a conviction, at the trial level, on Staten Island. Tim Turner is on his way home.

Justice Wayne M. Ozzi, who sentenced the defendant in 2019, could potentially vacate the conviction.

A Decision on my Motion for Actual Innocence will be handed down on March 30 by Justice Ozzi in Part 15. On December 8 a Hearing was held on my Motion to Vacate the conviction on grounds of Actual Innocence. If successful this will be the first Actual Innocence finding on Staten Island and only the 25th in the State of New York.

NY Legislature passes the "Parole Reform Bill" which will, if signed by Gov. Cuomo, stop Parole Officers from re-incarcerating parolees for minor technical violations like missing curfew or missing a reporting date.

Advocates are now pushing Governor Andrew Cuomo to sign the bill.
