A class action lawsuit has been filed against Berkshire Bank over its role in aiding and abetting Miles Burton Marshall, the Upstate New York fraudster charged with running a $100 million Ponzi scheme.

Darlene Stetson, who lost nearly $75,000 after trusting Marshall’s so-called “Eight Percent Fund,” expressed her dismay: “You put your trust in a ‘pillar of the community’ if you will, thinking you had nothing to worry about.”

She is part of a group of 369 victims seeking justice, accusing the bank of enabling the fraud despite prior warnings, and urges others to be cautious, saying, “If it seems too good to be true, it probably is.”

"The new lawsuit, which is seeking certification as a class action, alleges that Berkshire Bank ignored suspicious movements of large sums of money among Burton’s accounts. It pegs the scope of the alleged fraud at closer to $100 million.

'Banks have incredibly sophisticated fraud-detection systems that alert them almost immediately to any suspected fraudulent behavior,' Dan Centner, a partner with the law firm Peiffer Wolf Carr Kane Conway & Wise who is representing Burton’s investors, said Wednesday during a media event announcing the lawsuit. 'Berkshire Bank had those systems in place, and we know those systems worked,' he added, noting that the lender’s surveillance systems produced 'dozens of alerts' about Marshall’s activity that went unheeded."

Investors filed a class action lawsuit against the business associates of Daryl Heller, who owned a series of ATM-based investment products called the “Prestige Funds,” a corresponding ATM management company called “Paramount Management Group, LLC,” and other companies that were used to carry out an alleged $700 million Ponzi scheme.

The investors’ class action lawsuit was filed against Jerry Hostetter, Mir Jafer Ali Joffrey (a/k/a “Buck Joffrey”), Randall Leaman, and David Zook in United States District Court for the Eastern District of Pennsylvania. A lawsuit filed by Peiffer Wolf Partner Ashlie Case Sletvold last week on behalf of the East Palestine City School District against Norfolk Southern was covered by Youngstown's The Business Journal:

“'Simply put, we filed this lawsuit because Norfolk Southern lied,' Sletvold said during the [April 30] news conference. 'It lied to the East Palestine Board of Education and to the children of East Palestine.'

On Feb. 3, 2023, Norfolk Southern railcars carrying toxic chemicals derailed as it passed through the small village of East Palestine, creating a huge fireball and forcing the evacuation of nearly the entire community. Concerned that one of the railcars could explode, a decision was made to vent and burn off gas from the car, sending a cloud of toxic fumes into the atmosphere.

Sletvold said the train disaster was 'entirely preventable,' and that the decision to initiate a vent-and-burn plan on one of the railcars was done to clear the tracks as quickly as possible so Norfolk Southern could resume operations, and not in the interest of public safety. ”
