Tennessee just put every planning department in the state on a clock.
Public Chapter 1044 takes effect January 1, 2027. A permitting entity gets 30 business days to either approve your development application or deliver a written notice of deficiencies. Miss that and the application is deemed approved. Two notices is the cap. After the second they either deny in writing and refund half your fees, or grant conditional approval. Surety releases within 120 business days once an independent inspector confirms the work is done.
That is what everyone is going to post. Here is what they are going to miss.
Every one of those protections runs off a single trigger. The date of submission. Which means a city's only remaining defense is to never start the clock. Expect the next three months to be about intake, not deadlines. New completeness checklists where one missing sheet means the submittal was never accepted. Mandatory pre application steps. A staff acceptance step sitting between your electronic upload and your legal submission.
And one more thing worth sitting with. Most of the industry is reading this as a pure win. Read the objections instead. A reviewer who can no longer quietly work a problem out with you across four rounds, and who is capped at two notices, has one safe move left. Deny in writing and refund half the fee. A formal denial on the record is a worse outcome than a fifth redline. Build the submittal for a two notice world, not a five round one.
If you build in Wilson County, Lebanon is walking through its implementation policy twice. Wednesday September 16 at 10:00 a.m. and Monday September 21 at 2:00 p.m., both at City Council Chambers, 200 N Castle Heights Ave. Same material both dates. Their notice says the policy will include specific requirements for when an application is considered officially submitted. That is the sentence to show up for.
Ninety five counties. Three hundred forty five municipalities. One deadline and no two policies alike. Lebanon is the only jurisdiction I have found that has put a session on the calendar so far. If your city or county has noticed one, drop it in the comments and I will add it to what we are tracking.
