Legal Term of the Month: Dram Shop Law

Dram Shop Laws address when an alcohol vendor or establishment may be held liable for damages caused by serving alcohol to a person who was already intoxicated or underage. In Florida, these cases are highly specific and depend on strict legal standards, making them an important area of risk awareness for bars, restaurants, and other alcohol-serving businesses.

Understanding how liability is determined can help businesses strengthen compliance practices and reduce exposure to potential claims.

Florida businesses are approaching a July 1st compliance deadline requiring mandatory “Operations Charges” to be clearly disclosed on menus, receipts, and websites. The rule is part of Florida’s push for greater pricing transparency, meaning all fees must be clearly labeled and visible to customers before purchase.

Restaurants, bars, and hospitality operators should be auditing both digital and physical menus now to ensure pricing structures and disclosures meet the new requirements.

Spirit Law Partners can help businesses navigate these updates and stay compliant ahead of the deadline.

What made it all possible behind the scenes was strict alcohol licensing compliance, ensuring every activation, venue, and event operated within the rules during one of the busiest weekends of the year.

Is your beer and wine license hiding a compliance risk? 🍹

The 'Ready-to-Drink (RTD) Identity Crisis' is real. Malt-based canned cocktails are typically fine, but spirit-based ones require a full liquor license. Selling the wrong one can lead to heavy fines or license suspension.

Check your labels: identify malt vs. spirit.

- Malt-based RTDs: These are brewed from malt or sugar bases, similar to beer, and are typically permitted under beer and wine licenses.

- Spirit-based RTDs: These contain distilled spirits like vodka, tequila, or gin and generally require a full liquor license.

Not sure where you stand? We’re here to help you navigate the nuances. Contact Spirit Law Partners today.

Myth vs. Fact: Alcohol License Transfers

Buying a business does not mean the alcohol license automatically transfers. Most jurisdictions require a formal transfer application and regulatory approval before a new owner can operate under the license. Using the seller’s license without authorization can lead to fines, suspension, or even closure.

Spirit Law Partners helps ensure your license transfer is handled properly so you can avoid delays and penalties.

Florida’s legislative session has concluded, and HB 87 and SB 392 did not pass this year. The proposed legislation would have lowered square footage and seating requirements for Special Food Service (SFS) liquor licenses, potentially allowing more restaurants to sell beer, wine, and liquor without obtaining a full quota license.

While this change will not move forward at this time, Spirit Law Partners continues to monitor legislative activity that could impact alcohol licensing requirements across Florida and will provide updates on any future developments.

The Supreme Court has overturned the 'Liberation Day' tariffs on alcohol imports, ruling them an overreach of executive power under the IEEPA. This decision provides significant relief to importers, retailers, and hospitality operators by stabilizing market costs and removing substantial financial burdens.

While a major victory for the industry, Spirit Law Partners advises continued vigilance as other levies remain. Our team is actively monitoring how this impacts pending shipments and licensing agreements.

The clock is ticking on Miami Beach’s new special event permit rules ⏰

To reduce traffic and noise in residential neighborhoods, the city now requires permits for certain nonrecurring events where 100+ attendees may reasonably be expected, including those with amplified sound, large vehicle traffic, or commercial-grade setups.

📅 For the June 25–July 15 peak period, applications must be submitted at least 90 days in advance.

Failure to comply can result in:
• A 13-month permit restriction
• Fines ranging from $1,000 to $15,000

The ordinance is part of a broader effort to address quality-of-life concerns and limit large-scale party disruptions across Miami Beach neighborhoods.
