Habeas grant in Idaho- we are excited to report the Federal Judges Order was issued just this evening! Our deportation client gets to ask for a bond 8 USC 1236! 📚📚

From start to finish - assuming DHS complies with the order - 15 days of process 🗓️. I would estimate it took little less than 10 attorney hours 🕥. The best part, client got to remain in an Idaho jail - accesible to us and family for these past two weeks.

Filing a Habeas Corpus in Idaho just like I used to file a G-28. This is hard! The stakes are higher, so many more rules, so much formality, SO MUCH PROCEDURE. But if for no other reason but to maintain access to my client- at least for a time- until all can be explained and due process returns.

“Do I have to leave?” - a question frequently asked by immediate relatives of US Citizens. There is always a black & white answer and it’s dictated by Section 245 of the Immigration and Nationality Act. Unless you can prove you were inspected and admitted or paroled at your last physical entry to the US, or fall in the increasingly rare “pre-April 30, 2001-245i-exception” the answer is definitely YES.

Consular processing at a US Embassy or Consulate abroad is not for the faint of heart. Fortunately we have done it 100s of times for our Idaho neighbors.
