On June 14, 2021, the FDA issued a recall of certain Philips Respironics CPAP and BiPap machines.

The devices may emit polyester-based polyurethane (PE-PUR) into the user’s airway and can cause serious, life-threatening injuries. The risks include irritations to the skin, eyes, respiratory tract, inflammatory response, headache, asthma and toxic/carcinogenic effects to organs, headache, dizziness and nausea or vomiting.

Tennessee Supreme Court will decide whether there should be a limit to jury awards

This is a very important issue which can effect everyone in Tennessee. The Supreme Court will decide whether a jury should be allowed to assess damages for pain and suffering, or whether those damages are subject to an arbitrary cap of $750,000.00 imposed by the legislature. Stay tuned!

After a jury awarded a woman nearly $1.4 million in an injury case, the company that lost demanded a judge overturn the award under Tennessee law.

Dolphins help teen with cerebral palsy keep smiling

Many of our clients with cerebral palsy and other disabilities have benefited greatly from dolphin therapy, equine therapy and other animal therapies. This story from Island Dolphin Care in Key Largo, Florida describes some of the amazing benefits that this type of therapy provides.

A Boynton Beach, Florida, girl who has cerebral palsy swam with dolphins at a Key Largo marine mammal facility. The swim is part of the girl’s therapy for the condition.

The Holton Law Firm building, located at the corner of Washington and Lauderdale in downtown Memphis, has been a part of the fabric of downtown for many years. Initially built in 1938, the building served as the Municipal Service Station, complete with mechanic bays and fuel pumps. The building was later converted to a law office and has since been expanded and renovated several times. The Holton Law Firm is proud to be part of the 200 year history of Memphis. WARNING: Your smoke detector may not save you.

Everyone knows the importance of having working smoke detectors. We are reminded twice a year to check the batteries and test the siren. Most localities have building codes that specify where detectors must be located.

Did you realize that there are different types of smoke detectors and each type is not effective for all types of fires? When our office handled a horrific house fire case involving multiple fatalities, we did a lot of research into smoke detectors and learned some startling facts.

It turns out, the two main types of smoke detectors are ionization detectors and photoelectric detectors. An ionization smoke detector is best at detecting a flash fire that erupts and spreads quickly, but does a poor job of detecting a smoldering, smoky fire. A photoelectric smoke detector is best at detecting a smoldering, smoky fire, but does a poor job of detecting a flash fire.

If your smoke detector is not effective at detecting the type of fire that breaks out in your home, the results can be deadly. Most experts recommend putting a mixture of ionization and photoelectric smoke detectors on each level of the home. Some companies also manufacture a dual detector that is both an ionization and photoelectric detector.

Smoke detectors can be expensive and the cost of adding more may deter some from properly protecting their home. However, if a fire breaks out in your house, you would give any amount of money to have smoke detectors that can properly detect a fire and allow your family the extra time needed to escape.

J&J knew for decades that asbestos lurked in its Baby Powder

There had been a lot of chatter and grumbling about the size of the large verdicts against Johnson & Johnson. As suspected, the proof at trial involved evidence that J&J knew that their baby powder products contained asbestos and chose to hide that information and keep the products on the shelves. As a result of their greed, people got cancer. When corporations choose profits over people, the American people WILL hold them accountable.

Johnson & Johnson says its Baby Powder is safe. But Reuters found its talc was sometimes tainted with asbestos, a fact it kept from regulators and the public.
