⚖️ DCFS GUARDIANSHIP: AN OFTEN OVERLOOKED PERMANENCY OPTION
When people think about the outcome of a DCFS case, they often assume the only options are reunification or adoption. However, guardianship remains an important permanency option for many children.
Guardianship can provide a child with long-term stability, permanence, and continuity of care while preserving the legal relationship between the child and their biological parents.
As Illinois courts continue to emphasize the constitutional rights of parents and require careful analysis before parental rights are terminated, guardianship may be an appropriate permanency option in cases where adoption is not feasible, appropriate, or in the child’s best interests.
Guardianship may be appropriate when:
✔ The child has developed strong attachments to a caregiver.
✔ The caregiver is willing to provide long-term care and stability.
✔ Reunification is not presently in the child’s best interests.
✔ Adoption is not feasible, appropriate, or desired.
✔ The child needs permanence without additional years of litigation and uncertainty.
While every case is different, guardianship can offer children the stability they deserve while maintaining important family connections when appropriate.
Foster parents, relative caregivers, and fictive kin should understand that guardianship may be an available permanency option depending on the circumstances of the case.
