Attorneys: Timothy J. Manchin Tim Manchin was born in Farmington, West Virginia, and grew up in Bridgeport. Tim was strongly influenced at an early age by his deceased father, Joseph Manchin Jr., a well-known physical therapist who treated thousands of athletes and disabled persons without regard to their ability to pay. Tim then attended West Virginia University where he graduated from the WVU College of Law in 1980. In May of 1983, he began a successful law practice with his partner, cousin, and now Federal Magistrate, Michael Aloi. In addition to his work at Manchin Ferretti, Tim also practices law with the Fairmont, WV, based Manchin Injury Law Group. Through the years, Tim has represented thousands of West Virginians in all types of personal injury cases including medical malpractice, car accidents, workplace injuries, and wrongful death matters. Through this work, he has recovered millions of dollars for his clients. Tim is the nephew of the late A. James Manchin and cousin of United States Senator Joe Manchin. In addition to his successful legal career, Tim had distinguished career as a delegate and public servant of Marion County, beginning in 2003 through the end of 2016. He was appointed to the Rules Committee, House Finance Committee, Senior Services, Roads and Transportation, Banking and Insurance, Small Business Development, Chairman of Political Subdivision, and eventually became chairman of the powerful Judiciary Committee. Tim also was chosen to chair the Select Committee on Marcellus Drilling which produced the first law providing for the regulation and protection from Marcellus drilling activities. He was known among his peers as a tireless worker at the capital, frequently arriving before the other delegates and leaving long after their departure. Together with his law firm, Tim has provided assistance and financial support for numerous civic causes including the annual donation to the Family Resource Network of approved car seats for expectant mothers, sponsorship of UMWA charitable fundraisers and frequent donations to the Soup Opera. In his free time, Tim enjoys hiking, outdoor activities, and cheering on the WVU Mountaineers. Joseph R. Ferretti Joe Ferretti has been representing individuals in the Eastern Panhandle of West Virginia since co-founding the firm of Hammer Ferretti & Schiavoni along with his two partners in 1992. In 2018 after the retirement of Mr. Schiavoni and the election of Mr. Hammer to Circuit Court Judge in the 23rd Judicial Circuit the law firm of Ferretti Law Office, PLLC was formed which operated until Manchin Ferretti was started in 2020. In 33 years of professional associations, he has been committed to providing effective and personable service while ensuring success for his clients. He has successfully litigated or resolved cases for numerous clients with claims arising from auto accidents, pedestrian and cycling accidents, faulty home construction, medical malpractice and a variety of injury and death claims. After graduating from the University of Pittsburgh in 1984 with a B.A. in both Economics and Political Science and the University of Pittsburgh School Of Law in 1987, he began his legal career as an associate with a large West Virginia insurance defense firm. During his years there he litigated and tried to verdict numerous cases as defense counsel in motor vehicle accidents and medical malpractice cases. Current clients benefit from his prior experiences regarding defense strategies and trial tactics. Through trial work and successful mediations, arbitrations and settlement negotiations Mr. Ferretti and his law firms have obtained verdicts, awards and compensation for clients that now exceed $165 million dollars. Laura C. Davis With more than 20 years of experience litigating insurance bad faith, personal injury, and wrongful death claims, Laura Davis brings to Manchin Ferretti extensive knowledge and expertise. Laura Davis is well-respected by both her peers in the legal community and her clients alike. Downs Taylor B. Downs is a native of Martinsburg, who learned about hard work and results from a young age by helping his grandfather on the family farm and orchard. After graduating from Martinsburg High School, Taylor earned a B.A. in History and a B.S. in Political Science from Shepherd University. Taylor went on to earn a law degree from West Virginia University College of Law in 2011. Since graduating from law school, Taylor has focused on representing injured individuals throughout the State of West Virginia. In addition to being a partner at Manchin Ferretti, Taylor is also a partner in the Fairmont, WV, based office of Manchin Injury Law Group. To Better Share The Road With Motorcycles, Remember These Things:

· Do not share a traffic lane with a motorcycle. While it may appear that there is enough room in the traffic lane, keep in mind that motorcycles need room to maneuver.

· Nearly 50 % of motorcycle wrecks involve another motor vehicle with nearly 40 percent of crashes caused by the other vehicle turning left in front of motorcycles.

· At all times, make sure to signal your intentions before merging lanes in traffic. This will provide a motorcyclist the ability to anticipate traffic flow and find a safe lane.

· If you see a flashing turn signal on a motorcycle, don’t automatically assume the motorcyclist is turning. Motorcycle signals generally are not self-cancelling like cars and rides sometimes forget to turn them off.

· Keep in mind that road conditions, like small potholes, may be a minor inconvenience for cars but are a major problem for motorcyclists. Certain road conditions which may not be an issue for cars will cause motorcyclists to change speed and direction.

Kudos to the Jefferson County League of Women Voters for organizing an educational forum on campaign finance reform. On November 21, 2015 David Hammer presented a lecture on the topic of "The United States Supreme Court and the History of Campaign Finance Reform" to attendees at the Jefferson County League of Women Voters meeting held at Hospice of the Panhandle's beautiful campus. From the U.S. Supreme Court decision in 1886 assuming, without deciding, that corporations have Equal Protection rights under the 14th Amendment of the Constitution to the 2010 decision in Citizens United attendees came away with a better understanding of the history of campaign finance reform.

I heard a local legislator on the radio today discussing the Health Department's efforts to curb smoking in public places based on the studies showing the dangers of exposure to second hand smoke. The legislature clearly intends to overturn the numerous county health department rulings and limit such decisions to the County Commissions. This is the same legislature that wants to discuss Right to Work legislation. Apparently exposure to union activity on the job is more dangerous than exposure to second hand smoke.

STOP THE OUTRAGEOUS WORKER MURDER BILL

There are always examples of horrible bills introduced in any session of the legislature. However, nothing is more outrageous than House Bill 2011 which destroys a workers’ ability to seek full compensation when an employer KNOWINGLY violates workplace safety laws. In its drive for “economic development” at any cost and with no regard for the rights of workers, this legislature has introduced a bill that would make it harder to prove a case where the employer knowingly injured a worker than it is to prove a premeditated murder case! That’s right. When asked during a hearing to explain the bill, counsel for the legislature admitted that under this bill, it would be easier to prove a murder conviction than for an employee to prove an employer knowingly violated safety laws. It should be called the WORKER MURDER BILL. If this bill were in effect at the time of the Upper Big Branch Explosion, the widows and victims of UBB could not have recovered. Despite all the illegal activities of management at that mine, the standard of proof of House Bill 2011 would have been impossible to meet. Businesses who knowingly break the law and get workers injured or killed should not receive better treatment than others who knowingly break the law. Call your legislators now and demand that the insanity of House Bill 2011 stop.
