If Kia is legally responsible for car thieves, who's next?
That's not a rhetorical question. Chicago's public nuisance lawsuit against Kia and Hyundai uses the same legal theory that's been applied to gun manufacturers, opioid distributors, and social media companies.
The logic: if your product can be misused by someone to cause harm, you can be sued for that harm — even if you didn't commit it.
Follow that logic to its conclusion and every manufacturer, retailer, and employer in Illinois is one creative trial lawyer away from a massive lawsuit for something a third party did with their product.
This is why civil justice reform matters. The line between accountability and abuse has to mean something.
