Important SIJS Green Card Update 📢

The October 2026 Visa Bulletin brings an important change for certain Special Immigrant Juvenile Status (SIJS) applicants.

The EB-4 Date for Filing has advanced to January 1, 2025. This means certain SIJS applicants with a priority date before January 1, 2025 may be eligible to file Form I-485, Application to Register Permanent Residence or Adjust Status, beginning in October 2026, if all other eligibility requirements are met.

Your priority date matters. Check your I-360 approval notice and speak with an immigration attorney to determine how this update applies to your case.

We’re pleased to share another positive result for a Rathee Law Firm client Form I-360 approved for Special Immigrant Juvenile (SIJ) classification.

Special Immigrant Juvenile Status (SIJS) is an immigration classification available to certain noncitizen children in the United States who meet specific federal requirements and have qualifying state-court findings involving abuse, neglect, abandonment, or a similar basis under state law.

An I-360 approval is an important milestone in the SIJS process. However, every case is different, and approval of SIJ classification does not itself mean that a green card, visa, or employment authorization has been granted.

Major changes are coming for F-1 students. 🇺🇸🎓

Beginning September 15, 2026, the long-standing “Duration of Status” (D/S) framework is changing, making it more important than ever for F-1 students to understand their I-94 admission period, OPT/STEM OPT timelines, travel plans, and H-1B cap-gap eligibility.

🚨 Major H-1B Fee Proposal

DHS has proposed a new $103,265 additional fee for H-1B cap-subject petitions, including petitions eligible for the U.S. advanced-degree exemption.

If finalized as proposed, the fee would be paid at the time of filing and in addition to other applicable fees or payments. Certain cap-exempt H-1B petitions would not be subject to the proposed fee.

⚠️ Important: This is a proposed rule — it is NOT currently in effect.

Employers and H-1B professionals should stay informed as the proposal moves through the rulemaking process and consider how a significant potential filing cost could affect future workforce and immigration planning.
