After recently being stopped by an Iowa DNR officer for illegally operating a utility terrain vehicle (UTV) on a paved Boone County roadway, the individual sought to clarify applicable regulations. They were operating under the belief that ATVs and UTVs could be driven on any roadway in Boone County, with the lone exceptions being Story Street and Mamie Eisenhower Avenue in Boone.
Adopted July 1, 2016, County Ordinance No. 132 permits operating ATVs (all-terrain vehicles) and UTVs on any gravel roadway in Boone County lying outside the city limits of any incorporated city.
Operation on paved county roadways is never legal, though a resident living on a paved county roadway is permitted to operate on the road shoulder “for a reasonable distance” to reach a nearby gravel roadway.
ATV/UTV operators on county gravel roads must:
• Properly register and attach a provided identification plate to the rear of the vehicle
• Be age 16 or older with a valid Iowa Driver’s License
• Have and carry on the vehicle proof of liability insurance in effect for the vehicle, or other proof of financial responsibility per Iowa Code Chapter 321A
• Operate only between official sunrise and official sunset
• Not be operating under the influence of alcohol or drugs
• Have a functioning white light in front and red light in the rear
• Never exceed a posted speed limit and in no case more than 45 miles per hour
• Never operate in a roadway ditch
Violations of this Ordinance are a Simple Misdemeanor punishable by a fine of $65 to $625 plus applicable court surcharge and costs and/or up to 30 days in jail.
