Today, we are featuring Alana Chazan, JD, MA of Chazan Family Law, PC. A Los Angeles based divorce attorney, Alana is a fierce advocate for LGBT families. While she does everything she can to keep her clients' divorces smooth and amicable, if waters get rough, she will be there to fight hard for her clients. Alana has litigated the ONLY same-sex family law case in California that was heard before a jury, protecting a lesbian mother in Orange County from her estranged spouse who tried to portray her as a "nanny" to their children.

Alana is also on the board of the National LGBT Bar Association's Family Law Institute, and a volunteer for the LA LGBT Center's legal services department and their pro bono name and gender change clinic. An outspoken advocate for queer families, Alana is also a mother and a foster parent of two adorable little ones.

On a personal note, Alana has been a wonderful friend and mentor to Amira from her earliest days practicing law, and they are now trusted colleagues, sometimes co-counseling and sometimes working on opposing sides of donor and surrogacy cases.

Same-Sex Parents Still Face Legal Complications

Alana Chazan of Chazan Family Law quoted in the New York Times on the importance of second parent adoptions in today's political climate.

Laws covering parenting can be contradictory around the country, especially with adoptions. Custody issues can emerge even years after a child is born.

Many people have been asking me about how to best protect their marriages in light of this election. Marriages are considered valid if they were valid when entered. So even in a worst case scenario in which Trump & Co. somehow overturn same-sex marriage, it would not be retroactive. NCLR (who you should donate $ to if you can) put out a great statement on the issue yesterday which I am pasting below. Please feel free to share.

A statement from the National Center for Lesbian Rights as to the status of US marriage equality now and in the future:

"There is no realistic possibility that anyone’s marriage will be invalidated. The law is very strong that if a marriage is valid when entered, it cannot be invalidated by any subsequent change in the law. So people who are already married should not be concerned that their marriages can be taken away. To the contrary, it is important that they continue to live their lives as married couples.
Looking forward for individuals who are not currently married but who may wish to marry in the future, we also think it is highly unlikely that the fundamental right of same-sex couples to marry will be challenged or that the Supreme Court would revisit its 2015 holding that same-sex couples have that fundamental right. The doctrine of stare decisis—which means that courts generally will respect and follow their own prior rulings—is also very strong, and the Supreme Court very rarely overturns an important constitutional ruling so soon after issuing it. In addition, while the new administration is very conservative, neither Donald Trump nor anyone associated with his campaign has indicated any intention to try to turn back the clock on the freedom to marry, and the great majority of Americans now strongly support marriage equality."


Arriving to work with a lot of messages from scared clients today. And rightfully so. VP elect Pence has already vowed that Trump will turn back any and all LGBT rights and progress made under Obama.
