Fraud Alert: Scammers are "spoofing" the Arlington Immigration Court's phone line, making it appear that calls are coming from the court.

The Executive Office for Immigration Review (which manages the nation's immigration courts) has released the following statement:

"The Executive Office for Immigration Review (EOIR) today announced it has recently been notified of phone calls that spoof the Arlington Immigration Court as part of a misinformation campaign. The callers will often “spoof,” or fake, the immigration court’s main line, 703-305-1300, so the calls appear to be coming from EOIR on the recipient’s caller ID.

"In this scam, fraudulent callers posing as EOIR employees or officers advise individuals that their social security number has been compromised and request money from the victims. These calls are fraudulent; EOIR personnel do not call individuals regarding social security numbers or to request money. To protect yourself, be wary of answering phone calls from numbers you do not recognize. Never give out your personal information over the phone to individuals you do not know."

** Delayed Filing Receipts for Asylum Applications **

U.S. Citizenship and Immigration Services (USCIS) has released the following statement on delayed filing receipts:

"USCIS is currently experiencing delays in issuing receipts for Form I-589, Application for Asylum and for Withholding of Removal. Due to these delays, you may not receive a receipt notice in a timely manner after you properly file your Form I-589. For purposes of the asylum one-year filing deadline, affirmative asylum interview scheduling priorities, and Employment Authorization Document eligibility based on a pending asylum application, your filing date will still be the date that we received your properly filed Form I-589 (not the date we processed it). If you did not properly file your application, we will reject it and note any deficiencies in your filing. If you do not receive your receipt notice in a timely manner, please do not submit multiple Forms I-589, as this may further delay your case."

For certain Employment Authorization Document (EAD) renewal applications, USCIS has increased the automatic extension period from 180 days to 540 days. This temporary increase took effect on May 4, 2022. It does not apply to all applications. For specific information about your case, consult with an attorney.

U.S. Citizenship and Immigration Services (USCIS) announced a Temporary Final Rule (TFR) that increases the automatic extension period for employment authorization and Employment Authorization Documents (EADs), available to certain EAD renewal applicants, to up to 540 days.

A group of organizations in Maine have published a new report that is highly critical of the Boston Asylum Office for its low approval rate. According to the report (which is titled, "Lives in Limbo: How the Boston Asylum Office Fails Asylum Seekers"), "Asylum seekers who apply through the Boston Asylum Office face a unique challenge: an asylum grant rate that is well below the national average. From 2015 to 2020, the Boston Asylum Office, on average, granted a mere 15 percent of asylum applications, with some months granting as low as 1.5 percent of asylum seekers. In contrast, the national average grant rate was nearly *twice* as high: 28 percent."

Asylum applications are generally assigned to a particular office based on where the applicant resides in the United States. As this chart shows, asylum approval rates do vary significantly among the different offices. But other factors can also influence whether an application will be approved -- such as the strength of the claim, how well prepared the application is, and the strength of the applicant's testimony during his or her interview.

The Department of Homeland Security has announced the designation of Afghanistan for Temporary Protected Status (TPS) for 18 months. To qualify, an applicant must have been residing in the United States as of March 15, 2022 (in addition to meeting other eligibility requirements). If you believe you may qualify for TPS, contact an immigration attorney immediately for more details.

USCIS has again extended a temporary rule that requires most asylum applicants to use USCIS-provided interpreters (instead of bringing their own interpreters) at affirmative asylum interviews. This policy is now set to expire on March 16, 2023.

The Department of Homeland Security has announced the designation of Ukraine for Temporary Protected Status (TPS) for 18 months.

To be eligible for TPS under this designation, an applicant must have continuously resided in the United States since March 1, 2022. (Applicants must meet all other eligibility requirements for TPS as well.)
