John is listed in "Who's Who in America", and is a regular guest commentator in print and on tv and radio on law and politics including Fox News, the O'Reilly Factor, and Chris Matthews Hardball. John is a former federal prosecutor from New York who handled widely publicized federal criminal investigations and prosecutions that ran the gamut from securities fraud to a mob prison break, the bribery of Congressman Dan Flood by a rabbi, the federally funded summer feeding scandal in the South Bronx, and heroin-trafficking by major organized crime figures including "Matty" Madonna, who has been indicted since his release in an indictment in New Jersey. In private practice at the mid-town Manhattan law firm of Poletti Friedin Prashker Feldman & Gartner (founded by FDR Jr.), John represented all the airlines in the Air Traffic Controllers Strike in 1981, and negotiated a settlement for the Airlines amounting to $28,869,000.00. While John maintained a general private practice in the mid-80's, he continued to handle complex civil matters as well, representing John Maguire, the founder of a wholly owned hi-tech subsidiary, Software AG, NA, as well as Al Neuharth, the founder of USA Today. John also had a busy criminal docket that included complex multi-defendant, multi-jurisdictional securities fraud prosecutions, the targets of alleged defense industries fraud, and those targeted in political corruption investigations. John served twice on Capitol Hill. On the Senate side as Special Counsel to the U. S. Senate Judiciary Committee (appointed by Chairman Strom Thurmond to investigate Quadaffi's efforts to subvert American foreign policy), and then as Special Counsel to the U.S. Senate Labor Committee (appointed by Chairman Orrin Hatch to investigate the confirmation hearings of former Labor Secretary Raymond Donovan). On the House side, John served again as Special Counsel, investigating the mob's influence in the Laborers International Union, also their influence on the Teamsters International Union, and he made a nationwide assessment of the "American Worker." His most challenging assignment on the Hill, however, was his work on the historic Impeachment proceedings of President William Jefferson Clinton (for the democratic minority). John was Chief of Staff for Congresswoman Zoe Lofgren, representing Silicon Valley; he was responsible for forging bi-partisan legislative initiatives, serving as liaison with the minority leader, and lending his expertise in hi-tech policy making and legislation. After Congress, John returned to practice at a firm, since re-named, CAMPBELL FLANNERY, PC ( www.CampbellFlannery.com ). John's litigation practice was both civil and criminal, trial and appellate, federal and state. John's criminal defense and appellate practice, at the federal and state level, focussed on white collar criminal defense including several significant chronic pain cases, most particularly, the Florida State appeal of Richard Paey, a chronic pain patient, unjustly sentenced to 25 years for receiving pain medication, featured on Sixty Minutes; in September 2007, after the Court of Appeals denied the appeal (read the dissent), John argued to the Governor for Richard's release from prison, and Governor Crist granted a full pardon; John also fought successfully to reverse the unfair conviction of Dr. William Nucklos in Ohio; John associated in these efforts with the Pain Relief Network, headed by its founder and President, Siobhan Reynolds; it is because of Richard and other pain cases, that John wrote his book, "Pain in America - and how our Government makes it worse!". John's civil practice includes complex fraud and contract litigation involving labor, land use, employment, contract, corporate entities (whether it's formation, or dissolution), buiness hi-tech, IP, Sarbanes Oxley, and a general civil practice, as well as government relations. Mr. Flannery holds undergraduate degrees in Physics (BS, Fordham) and Industrial Engineering (BS, Columbia), a law degree (J.D., Columbia), and a Masters Degree (Masters in Information Science, GW Graduate Business School). The law, whether by statute, rule, or case law, is a good place to start many a discussion about policy, as it removes a lot of the heat when a policy question is characterized as merely political. I think of the statutes, rules and case law as a societal standard by which we have more generally agreed to address the challenges of our society. That doesn't mean we have to agree on everything. Spouses don't. Close friends don't. But this manner of thinking might lead to more civility. As for speech, about matters of public interest, there's nothing wrong about it being robust.

BILLY MURPHY - is a great advocate for individual rights and liberty and human dignity.

He's being acknowledged because of his role as friend and counsel for Freddie Gray's family in the troubles that have alighted upon Baltimore, where Billy makes his home, personally and professionally.

But he's been doing this forever, fighting the good fight, mostly because he cares about people and has a strong sense of what's right and good.

When I was more active in the National Association of Criminal Defense Lawyers (NACDL), we visited more frequently.

Once, we shared a table, I think it was at a ski resort, and Billy took it upon himself to go to a nearby portion of where we were dining to pick out jazz favorites that he thought fit some of us sitting around the table. I'm pretty sure he gifted a selection of Herbie Hancock. I still play it. Who wouldn't? Hancock is a classic. We talked about drummers. i favored Gene Krupa, an old stand by. He said not bad for a white drummer.

More significantly, we talked about how you keep the flame of passionate advocacy refreshed, and agreed that it was unlikely to go out for us as long as government, in its various iterations, favors injustice and misconduct and is blaise about guilt and innocence; and we cherished and celebrated those officials who shared our respect for an individual's right to be let alone.

Is DOJ railroading Senator Menendez with bogus charges they know or should have known are false - is this Senator Stevens redux? - consider this excerpt from WAPO -
"Under questioning from Koski before the grand jury, the FBI agent said Sebelius and Medicare chief Marilyn Tavenner both knew that Menendez’s purpose in the meetings was to advocate for Melgen, according to the filings from Menendez’s lawyers.
“Was it also clear that the meeting was about Dr. Melgen?” Koski asked the FBI agent, Gregory Sheehy, according to a grand jury transcript included in the defense filings.
Sheehy responded: “Perfectly clear. . . . It was all about Dr. Melgen, the meeting.”
But the defense contends that the agent’s description to the grand jury directly contradicted what the officials had told the FBI.
Excerpts of internal FBI memos summarizing agents’ interviews with Tavenner and Sebelius suggest that there was no such clarity, the filings say.
“Tavenner said they did ‘not specifically discuss Melgen’ and she at least twice noted that she could not remember if his name even came up,” according to an excerpt of an FBI memo cited by the defense.
Sebelius “said she could not recall whether MELGEN’s name specifically came up during the meeting,” another memo said. She “could not recall what MENENDEZ specifically wanted.”

Replace that Statue by John Flannery

REPLACE THE CONFEDERATE STATUE WITH THE BUST OF THE REVEREND MARTIN LUTHER KING.

There was a song of the civil rights movement that never gets old – “We shall overcome” – especially since the movement still struggles to find a foothold in the most resistant of individuals who can’t let go of intolerance and hate.

In recent days, it feels like a flashback to the 50s and the 90s – the wanton killing of Blacks in Church, and the burning of Black Churches. Nor is it reassuring that the K*K plans to mass in South Carolina to insist that the State restore the Confederate Flag – and fly it high.

The hope is that others who remember and believe in the promise of America will recoil from this distasteful and odious conduct, that they will not suffer these outrages in silence, not tolerate the hate and division that has become so undeniable in recent days, that they’ll do som**hing about it, both symbolically and substantively.

A local symbol in our County, not unlike those to be found in many Counties in the South, is the Confederate statue that stands before our historic court house at the County seat, in Leesburg, Virginia.

The statue has been there since 1908 and it’s time it was gone.

It’s quite discouraging that so many are indifferent to the divisive statement the statue makes, and they are “just fine” that it stands there before our court house.

I’ve also found a world renowned sculptor who lives in Lovettsville, VA who has an heroic bust that could properly replace that Confederate statue.

The bust is of Martin Luther King who gave his life, shot to death, for promoting peace, equality and individual freedom.

Presently, there is a plaque on the sidewalk outside the town green, commemorating the Rev. King. But we need a grander gesture – especially in these trying times. I propose that we make a memorial inside the green, that it be the bust of Martin Luther King, and that it supplant that Confederate statue, in other words, have the statue removed to a more appropriate venue.
