The toughest question I get asked as a lawyer is, "What do you think I should I do?" This is especially tough with estate planning clients, who are looking for suggestions on how to handle certain situations. For example, lets say the client wants to leave his house to his two adult children, but worries that one of them will want to keep the house and the other will want to sell it. The client isn't sure how to resolve that conundrum and is looking for suggestions. I'll go over the client's options with him and explain the various pros and cons of each, but ultimately, the client has to make the decision. When the client asks, "What do you think is the best way to handle that?" it is tempting to recommend a course of action, just as I would for a criminal defense client or a litigation client, but in the estate case, this is supposed to be the CLIENT'S last will, not mine.

There are two methods of getting a divorce: 1) you can agree that the relationship has ended and try to work through the problem of untangling your lives and assets through compromise and agreement; or, 2) you can have a knock-down drag-out in the courts and litigate the entire process. Guess which one is better for us and which one is better for our clients?

Divorce with dignity. It's not only possible, it's preferable.

The schedule has been released. Magner Law will be traveling to Richmond on January 10, 2019 to appear before the Virginia Supreme Court. We will be arguing our appeal in the case of Mercer v. MacKinnon, and the issue is whether a non-US Citizen who gets appointed as a conservator for an incapacitated person in a Virginia Court, but then returns to their own country with the money can be hauled back into a Virginia Court to answer for her use of the funds. I have personally been working on this case for close to four years, and if we win, we will be headed back to the Loudoun Circuit Court for trial. Wish us, and our client, luck!

Great teamwork, guys! Magner Law sealed up a very good and very fair mediated settlement this afternoon for a client who was injured in a dog attack. It took two of us and a very dedicated and hardworking client all working together to get it done, but we managed to walk out of there with a solid, respectable deal. Job well done!

Magner Law is headed to Richmond! Firm principal, Jim Magner, will appear before the Virginia Supreme Court on May 18, 2018 to argue its petition for appeal on behalf of an estate client of the firm. The case is: Virginia Lynn Mercer, Administrator of the Estate of Clifton Wood v. M. Lori-Belle MacKinnon, et al., Record No. 180358. The case tests the jurisdictional limits of a probate court to recover assets of an estate that have been removed to Canada. Wish us luck!

Magner Law earned a nice victory for a business client today in a trial involving a construction contract. However, the case was both cautionary and a little bit frightening, as it pointed out the dangers of do-it-yourself lawyering. Had opposing counsel drafted the contract instead of his client, the outcome might have been different. The other side may have saved a few bucks by writing its own agreement, but it ended up costing them dearly. If it matters for your business and your livelihood, then it aught to be worth doing right.

I am very pleased to announce that I have been appointed as a special justice for the 20th judicial circuit. I will be hearing cases involving civil commitments and end of life medical care disputes. This is a great honor to be able to serve my community in an area of the law that has become near and dear to my heart.

Do you have an IRA? When was the last time you looked at how your beneficiaries were designated? Most of us probably filled out a form, puts some names and addresses down, and never gave it another thought. However... as it turns out, the wording on those forms is actually very important. Not being specific enough can have expensive consequences for those we leave behind.

Get it in writing! That's good advice, but I'll go one step further - make sure that writing is clear and unambiguous. Recently, I was assisting a client with a dispute over change orders to a construction contract. It was great that the changes had been put in writing, but it was nearly impossible to tell what was being changed from the original contract. A small lack of clarity nearly cost the client thousands of dollars. So, after you put it in writing, but BEFORE you sign it, give it to someone else to read and ask them if it makes sense. If not, it probably won't make sense to a juror later on.
