PTSD & Workers' Compensation in Nevada
June is PTSD Awareness Month, and it's important to know that PTSD can be a workplace injury under Nevada workers' compensation law.
Many people associate workers' compensation with physical injuries, but certain psychological injuries, including PTSD, may also qualify for benefits.
👮First Responders
Police officers, firefighters, EMTs, correctional officers, and other emergency personnel are routinely exposed to traumatic events in the course of their duties. Nevada law provides specific protections that may allow qualifying first responders to pursue PTSD-related workers' compensation claims.
Examples may include:
✔️ Responding to fatal accidents or violent crime scenes
✔️ Witnessing serious injuries or deaths in the line of duty
✔️ Mass casualty or disaster response situations
✔️ Repeated exposure to traumatic incidents over time
👷 Other Workers in Nevada
For most non-first responders, PTSD claims are more limited and typically require a sudden, traumatic event involving extreme stress and immediate danger. In many cases, the worker must have been exposed to an event where they reasonably believed their life was in danger.
Examples may include:
✔️ Being held at gunpoint during a robbery
✔️ Surviving a workplace assault with life-threatening circumstances
✔️ Experiencing an explosion, collapse, or similar life-threatening event
What Typically Does NOT Qualify
❌ Job stress or burnout
❌ Performance reviews or discipline
❌ Workplace conflict or criticism
❌ Layoffs, demotions, or transfers
❌ Gradual stress over time without a traumatic incident
Nevada law draws a clear distinction between ordinary workplace stress and a qualifying traumatic event involving immediate danger.
