Michael Kagan, Joyce Mack Professor of Law and Director of the UNLV Immigration Clinic, published an article called “Second-Class Asylum, Third Country Danger” as part of a symposium convened by the Southern Methodist University Law Review. It tackles a crisis of third country removals for people who are in danger of severe human rights abuses in their countries of origin.

Our clinic students and staff attorneys have successfully litigated cases involving people in danger of persecution and torture abroad for many years. This practical, frontline work informs the article, in which Prof. Kagan argues that the third country removal problem stems from an incoherent set of policies in the Immigration and Nationality Act. Prof. Kagan proposes several policy options for the executive branch and Congress that would fix the problem and make the law more logically consistent while protecting people from human rights abuses.
