Who Gets the House in a Divorce? 🏠

The answer depends on more than whose name appears on the deed. In a Nevada divorce, the court may consider when the home was purchased, how it was financed, whether community or separate funds were used, and whether a valid marital agreement applies.

Common outcomes include:

• Selling the home and dividing the proceeds
• One spouse buying out the other’s interest
• Refinancing the mortgage into one spouse’s name
• Allowing one spouse to remain in the home temporarily under an agreement or court order

If one spouse owned the home before marriage or used separate funds for the down payment or improvements, additional ownership or reimbursement issues may need to be addressed. Financial records can be essential when tracing those contributions.
