The Empathy Before Impasse

Every mediator encounters cases that are simply not ready to settle.

The positions are too far apart. The evidence is disputed. Authority is limited. Reality has not yet caught up with expectations.

But even when agreement is impossible, the mediator’s work is not finished.

Some of the most meaningful moments in mediation occurs after the mediator recognizes that an impasse is inevitable in a case, where party emotions are running very high.

That can be when a mediator’s empathy becomes more than a communication skill.

It becomes a professional responsibility.

In a recent homeowner insurance mediation, I knew early on that the issues were unlikely to be resolved. Rather than forcing negotiations that would only increase frustration and expense, I focused on something equally important:

Helping an emotional homeowner feel heard, understood, respected, and rationally prepared for the next steps after impasse.

Sometimes the greatest value a mediator provides is not moving parties to agreement.

It’s moving them from emotion to understanding.

This week’s Mediator’s Roundtable from ADR Masterclass & The Mediation Center of Central Florida Inc., looked at what it actually means to be a Good Mediator.

The discussion focused less on the mediator's technique and more on what we bring with us to the mediation process. Authenticity, adaptability, and a mediator's ethics; as well as the careful balance mediators must maintain between party self-determination and effective process management were big parts of what we spoke about.

Interestingly, we recognized an underlying theme that runs through nearly every weekly Mediator’s Roundtable discussion:

Great mediators don't simply facilitate conversations in mediation, they intentionally “Guide the Process” without taking ownership of the outcome.

Below are Five (5) Practical Takeaways from this Week's Roundtable:

1. Neutrality & Impartiality Must ALWAYS Be Visible to the Parties:
Being Neutral as to the outcome of mediation and Impartial as to Fair Access to the Process is not enough. Every participant MUST believe the mediator is treating everyone fairly.

In mediation “Perceived Value” & “Perception” often matter as much as intention.

2. Empowering Parties Is Not Giving Legal Advice:
Helping parties create space in order to realistically evaluate risks, costs, potential offers, and likely outcomes is one of the mediator's greatest responsibilities.

The mediator must deftly walk the ethical tightrope between empowerment and avoiding directing decisions, sharing personal opinions, coercing party determination or giving legal advice.

3. Know When to Step In:
There are moments when allowing parties to continue is productive, just as there are moments when the mediator must interrupt, reframe, caucus, or redirect the conversation before the process loses momentum.

4. There Is No Universal Mediation Formula:
Every case requires flexibility as mediation is context driven. Case-by-case is how the mediator approaches each and every case.
Different personalities, power dynamics, culture, and negotiation styles demand different mediator approaches.

5. Measure Success Beyond Settlement:
Success in mediation isn’t measured by a mediated agreement. Success is measured by the mediator overseeing a fair process, promoting informed decision-making, preserving party self-determination, while also ensuring participants feel heard and respected.

The mediator’s job is to help parties create the best outcome for their case in the moment and place the mediator finds them.

Even Impasse can be Successful when it moves the parties toward resolution.

Always address unseen 3rd-party participants in virtual Opening Statements! This establishes clear expectations regarding confidentiality & procedure.

Professional mediators must view platforms like Zoom & E-Signature software like Docusign, & other needed software tools as essential business infrastructure!
