📄 What Is a Petition for Dissolution of Marriage in Illinois?

A Petition for Dissolution of Marriage is the legal document that officially begins a divorce case in Illinois. It is filed with the Circuit Court by the spouse seeking the divorce (known as the Petitioner) and tells the court what relief is being requested.

What Information Is Included in the Petition?

A Petition for Dissolution of Marriage generally includes:
• The names of the spouses
• The date and place of the marriage
• Whether either spouse meets Illinois' residency requirements
• Whether the parties have minor or adult dependent children
• A statement that irreconcilable differences have caused the irretrievable breakdown of the marriage (Illinois is a no-fault divorce state.)
• A request for the court to dissolve the marriage
• Any requests regarding:
• Allocation of Parental Responsibilities (Child Custody)
• Parenting Time (Visitation)
• Child Support
• Spousal Maintenance (Alimony)
• Property Division
• Allocation of Marital Debts
• Allocation of College Expenses, when applicable
• Any other relief authorized under Illinois law

Does Filing the Petition Mean the Divorce Is Final?
No.

Filing the Petition simply starts the legal process.

After the Petition is filed:
• A Summons is generally issued.
• The other spouse must be served with the court papers unless service is waived.
• The Respondent has the opportunity to file an Appearance and a Response.
• The parties exchange information, negotiate, participate in mediation when appropriate, attend hearings, or proceed to trial if necessary.

The divorce is not final until the judge enters a Judgment for Dissolution of Marriage.
