“My case was dismissed, so it's completely gone, right?”

Not necessarily.

A dismissal and an expungement aren't the same thing.

A dismissal means the criminal case did not result in a conviction. But questions about what records remain, who can access them and whether they can or should be expunged involve a different part of Missouri law. Missouri statutes separately address arrest records, cases that do not result in conviction and expungement.

So if an old arrest or dismissed case is still causing problems, don't simply assume there is nothing you can do about it.

Ask what the record actually says and what options may be available.

You have probably heard someone say they had a criminal record “wiped clean.”

That is usually what people mean when they talk about expungement, but the reality is a little more complicated.

In Missouri, certain criminal records may be eligible to be closed through expungement. Eligibility depends on the offense, how much time has passed, your record since the offense and other factors. Expungement laws have changed, including new provisions having taken effect in 2025.

The important part? Expungement doesn't simply mean pretending something never happened.

“The police had probable cause.”

That sounds an awful lot like saying, “The police proved I did it.”

It isn't.

Probable cause is a legal standard used in determining whether law enforcement has sufficient grounds for actions such as making an arrest. It is a much lower standard than the proof beyond a reasonable doubt required for a criminal conviction. Missouri's DWI guidance, for example, distinguishes between reasonable suspicion for a traffic stop and probable cause for an arrest.

An arrest is not a conviction. Probable cause is not a finding of guilt.

Understanding the difference can be pretty important when you are the person facing the charge.

Three letters you hear a lot in Missouri courtrooms: SIS.

It stands for Suspended Imposition of Sentence.

In simple terms, the court holds off on imposing a sentence while you complete the requirements placed upon you, which may include probation. An SIS can have significant implications for how a case ultimately appears on your record.

But an SIS is not the same thing as having your case dismissed, and it does not mean the arrest never happened. Missouri law even distinguishes an SIS when addressing eligibility for certain types of arrest-record expungement.

If someone tells you, “Don't worry, you're getting an SIS,” it's still a good idea to understand exactly what that means for you.

It was a good week last week at the Cole County Courthouse.

Two clients came to me facing tickets for driving 90 mph in a 65 mph zone. Both cases we were able to get amended to 1–5 mph over the speed limit, no points, with a $300 fine plus court costs. Even better, neither client had to miss work to appear in court.

Another big win this week: juvenile court jurisdiction was terminated for a client. For the Mama of the juvenile, this was a very big win.

Every case and every client is different, but helping people navigate the legal system and working toward a better outcome is what I’m here to do.

A few good results. A few relieved clients. And a pretty good week at the courthouse.

But "agreeing today" doesn't always prevent problems tomorrow.

A divorce decree needs to clearly address property, finances, parenting, and future responsibilities. Small drafting mistakes today can become expensive legal disputes years later.
