Due to COVID-19 all in-person court proceedings in Tennessee have been suspended through the end of March and proceedings in the U.S. District Court for the Western District of Tennessee have been continued until April 17, 2020. As a precaution we are closing our office to the public, with access to our office to be available by appointment only. It will be our policy to try and handle as much as possible by phone, email or other remote means. Our office can be reached at (731) 300-6260.

82 new laws to take effect in Tennessee July 1

There are 82 new state laws going into effect today, including stronger penalties for texting while driving, a "slow poke" law requiring cars to stay out of the left lane of three-lane interstate highways unless passing, online voter registration and wine sales in grocery stores.

A number of the laws will impact the safety of Tennesseans.

Supreme Court Modifies Summary Judgment Standard | Tennessee Bar Association

The Tennessee Supreme Court released an opinion yesterday in a Memphis healthcare liability case modifying Tennessee's standard for summary judgment to put it back in line with the standard under the Federal rules. This ruling will make it easier for defendants with frivolous claims filed against them to obtain a dismissal when a plaintiff doesn't have enough evidence to establish a claim.

Woman's Efforts to Change Will Without Professional Assitance Backfire | ElderLawAnswers

An interesting case out of Minnesota is a reminder that when drafting a will or changing a will you should always seek qualified legal assistance. The lady in this case was trying to help her grandson, but ended up costing him a large sum in legal fees after she died.

Just as making a will without the help of a qualified attorney can be dangerous, trying to change an existing will on your own can fail as well. A recent court decision in Minnesota serves as a cautionary reminder to anyone thinking of altering their estate plan on their own.

Wagner: ‘Guns in trunks' law revision creates workplace issues

A new TN law taking effect today allows employees who are TN handgun permit holders to pursue a civil action against their employer if any adverse action is taken against them by their employer as a result of having their firearm in their vehicle on the employer's premises.

In 2013, Tennessee enacted the so-called guns in trunks law. This provided a defense to criminal prosecution for a handgun carry permit holder, if parked on property where the owner prohibited firearm possession.

New Tennessee ride-sharing law hailed as model for nation

TN's new ride sharing law goes into effect today. The new law establishes insurance requirements and requires criminal background checks for drivers for ride sharing companies like Uber and Lyft.

NASHVILLE -- A top official at the ride-sharing service Lyft and Sen. Bo Watson, R-Hixson, say Tennessee's new law that allows the car-booking company, as well as other firms like Uber, to operate statewide can serve as a model to other states.
