Gillespie Law Firm PLLC was honored to speak at Isanti’s April Entrepreneurial Workshop:

The Business Structure: Legal Steps to Legitimacy

Attorney Rachel K. Gillespie is “pressure prompted,” as local photographer, JoJo says. She would have invited “y’all” to the workshop if she was confident it would be worthwhile.

Special thanks to the City of Isanti, the North 65 Chamber of Commerce, the East Central Regional Development Commission, and also special shout out and thanks to one of Attorney Rachel’s heroes, mentors, AND friends, Neva Walker(!!!). Attorney Rachel was lucky to be her Legislative Assistant and is especially lucky to continue to learn from her and be friends with her hero.

Our Rebuttal to What NOT to do Wednesday is
Entitled What To Do Wednesday:

Many of my friends, clients, and neighbors have worked hard to build a life and provide for the people they love.

Most would agree—they’d rather keep the government out of their pockets.

But here’s the reality:

If you pass away without an estate plan, you still have one—it’s just the State’s plan.

At Gillespie Law Firm PLLC, we help you take control.

A thoughtfully prepared will or estate plan ensures that what you’ve worked for goes where YOU want it to go: to your loved ones, your community, or the causes that matter most to you.

What to do:

✔ Create a will
✔ Name your decision-makers
✔ Protect your legacy

Because leaving it up to the government isn’t a plan—it’s a risk, and it is what NOT to do. Don’t let the government shackle your legacy.

The North Remembers.

At Gettysburg, Minnesota stepped forward into near-certain death and held the line.
Over 70% fell, buying the Union its future.
(Gottfried, Bradley M., Brigades of Gettysburg.)

Private Marshall Sherman captured and carried back the 28th Virginia flag, not as a trophy, but as testimony.
A reminder that winning the war meant more than survival.

Blood was shed for that flag.
Memory matters.
For many of us, even today, it means hope, that one day those famous three words in the Preamble of our Constitution,

WE THE PEOPLE

would grow to include me,would include you, would include all of us,
regardless of skin color.

And now, as then, we lift our voices and sing. We unite in nonviolent action.

We stand in solidarity, whether in person or in spirit, for a law and order that protects the dignity of the human person, and provides liberty and justice for all.

Winter is here. And the North Remembers.

Today, hundreds of Minnesota businesses are closing as part of the “ICE Out of Minnesota” economic blackout, a coordinated protest against the increased presence of ICE and to stand with those calling for ICE to leave our state.

Many are choosing to pause work, school, and shopping in solidarity with our neighbors and community members affected by these federal enforcement actions.

While we stand in solidarity with that calling for fairness, dignity, and feel passionately about the rights of all people, we also have important legal work to do that cannot wait.

Our firm will be open and working today, but we will be working remotely due to the e-learning day in our school district.

Our clients depend on us and justice does not stop. We continue to honor the Constitution and the rule of law as living principles worth defending.

Justice never sleeps, and neither does our commitment to serving those who rely on us.

At Gillespie Law Firm PLLC, we want to take a moment to recognize National Law Enforcement Day, even though we missed acknowledging it yesterday.

Attorney Rachel Gillespie is proud to count many dedicated law enforcement officers among her closest friends , including those who have served in leadership roles across our state. Rachel and her family feel safer because of the commitment to community-focused policing demonstrated by Minnesota’s local agencies and the extensive training they receive, including in de-escalation techniques and constitutional use-of-force standards grounded in Graham v. Connor, 490 U.S. 386 (1989), and the Fourth Amendment’s protections against unreasonable seizures.

We also recognize the sacrifices that officers and their families make daily to protect and uphold the rule of law. We extend our sincere thanks to our local law enforcement agencies for the professionalism, responsiveness, and care they bring to our communities. Your presence and partnership help ensure that our family, our clients, and our law firm feel safe, supported, and protected, and we are deeply grateful for the work you do every day.

At the same time, we were deeply saddened and disturbed by the fatal shooting in Minneapolis on January 7, 2026, in which a U.S. Immigration and Customs Enforcement (ICE) agent shot and killed a woman during a federal enforcement action.

Under both Tennessee v. Garner, 471 U.S. 1 (1985), and Graham v. Connor, deadly force is justified only when a reasonable officer in the same situation faces an imminent threat of death or serious bodily harm. Federal law enforcement policy similarly restricts the use of deadly force to such circumstances, and questions about how those policies are applied — and how training in those policies is provided — deserve thoughtful public scrutiny and independent review.

We are disappointed by what appears to be a lack of transparency in federal training and accountability standards for ICE agents, and share the concern of many that this tragic incident underscores the need for training and oversight that reflect constitutional safeguards and community trust. We join voices calling for a thorough, transparent investigation and for federal policy reforms that ensure all officers — local and federal — are equipped and trained to protect life and constitutional rights.

Today, on Tuesday, December 30th, I have a (remote) mediation all day, during which my access to email and phone will be limited.

I will respond to your messages at the earliest opportunity.

Thank you all for your patience and understanding, not only today but always, as I get into the rhythm of running my law firm.

And thank you, Diane and Dan, for the wonderful quote of Chief Justice Earl Warren you framed for me.

Diane Gerth, Esq., you are the best!
You knew I needed this constant visual reminder to “keep catching hell!” because it IS WORTHWHILE.
