If You Die Without a Will in Alabama, Here’s What Really Happens:

-The state’s “intestacy” laws decide who inherits your property (and it’s often not what you’d expect).
-A court may appoint a guardian for your kids — not necessarily who you’d choose.
-Your spouse may not automatically inherit everything.

To discuss how to avoid these uncertainties, schedule a consultation with me today.

The Hidden Costs of Skipping an Estate Plan

• Avoiding estate planning may save money now—but it often costs families much more later.
• Probate fees, court costs, and family conflicts can drain both finances and emotions.
• A customized plan can prevent these issues and ensure your assets go where you intend.

A clear plan provides peace of mind and prevents unnecessary legal complications for your family.

If you’d like to start the estate-planning process on your own, here are a few helpful steps:

-Make a list of all your assets — bank accounts, vehicles, digital accounts, and personal items. You likely own more than you realize.
-Decide who should receive those assets, even if they seem minor. Sentimental items can hold deep value for loved ones.
-Choose a trusted executor who can handle your estate responsibly and ensure your wishes are carried out.

The #1 Mistake Parents Make When Leaving Money For Their Minor Kids:

#1 Mistake: Choosing the wrong person to manage the funds, which can result in the need for legal action on the child’s behalf.

• Avoid leaving large sums outright to minors. Remember, in Alabama, a child is not considered an adult until the age of 19.
• Instead, choose an adult with good character to manage the funds on your child’s behalf. Consider the person’s connection to the child and their ability to manage funds responsibly.
• Define how and when the money can be used (e.g., education, milestones, age-based releases).

Schedule a consultation with me today to get guidance on leaving money to your minor children the right way.

Do You Really Need a Will If You Don’t Own Much?

Even if you don’t have significant assets, having a plan for what you do own can ensure that your loved ones are cared for and that your property can be distributed the way you’d want it to be distributed.

A clear plan provides peace of mind and prevents unnecessary legal complications for your family.

If you’d like to start the estate-planning process on your own, here are a few helpful steps:

2. Decide who should receive those assets, even if they seem minor. Sentimental items can hold deep value for loved ones.
3. Choose a trusted executor who can handle your estate responsibly and ensure your wishes are carried out.

Sole Proprietor has a name that describes itself.

sole (adjective): being the only one; having no sharer; functioning independently and without assistance or interference.

proprietor (noun): a person having a legal right or exclusive title to something.

(Definitions from www.merriam-webster.com)

Why? Because it’s very inexpensive to start, and it’s the least complicated entity out of all the business structures to choose from.

The money/resources needed in order to operate? You provide.

Particular business strategies needed to be taken? You decide.

If you’re looking to grow your estate by starting a business as quickly as possible, a sole proprietorship might be a great start.

As the owner (sole proprietor), the law sees you and the business as one.

Who said, “I’m not a businessman. I’m a business, man"? (Help me out by leaving the answer in the comment section if you know. LOL.)

If you are seeking to become a sole proprietor (or already are one), this quote is/would adequately describe you.

When I was much younger, I used to sell cheesecake during the holidays to my friends and family. The moment I sold/attempted to sell a Caramel Pecan cheesecake, I became a sole proprietor, even though I had not filed any legal paperwork.

Have you or your children ever set up a lemonade stand or offered to cut your neighbors’ grass during the summer for some extra cash? Whether you knew it or not, you/your child were self-employed as sole proprietors.

Even though sole proprietors do not have to file Articles for Formation with the state, I'd always advise them that, in addition to obtaining adequate insurance coverage, they may need to obtain various licensures and permits at the state or local level, depending on the type of business they’re seeking to operate.

A family friend sent me this text a few days ago.

Question: Will a trust executed in one state be valid in another state?

Answer: As long as the trust was created following the laws of the state in which it was created, your trust would be recognized as valid in any other state/territory.

Don’t let life changes/relocations hinder you from making the necessary plans/changes in your estate matters. You can start your planning process today.
