Employers, be sure to maintain employee files at your primary business location and keep good records, especially pay and vacation records. This week I encountered an employer that did not maintain vacation records and then when the employee's term was ended, they didn't have a clue how many vacation days he had taken. MAINTAIN GOOD PERSONNEL RECORDS AT ALL TIMES.

Otherwise, you could get a $750 fine for failing to allow an employee to review his/her personnel file, and you may be subject to wage time penalties and interest upon an employee's termination if not paid adequately.

Did you know?

In California, minimum wage increases to $10/hr in 2016, and Los Angeles is the largest city to guarantee $15/hr.

In June, Mayor Garcetti signed into law an ordinance that .increases the city's minimum wage from $9/hr to $15/hr by 2020 . The ordinance applies to most employers upon the effective date of the ordinance while small businesses and nonprofits have delayed enforcement until 2017.

"This proposed ordinance establishes a minimum wage of $15 per hour in the City of Los Angeles. The minimum wage requirement would apply to most employers upon the effective date of the ordinance, and to small businesses and nonprofits on January 1, 2017. The minimum wage rate is subject to a yearly increase based on the Consumer Price Index for Los Angeles. The ordinance provides that tips or service charges shall be retained by employees and shall not be included in the minimum wage calculation. The ordinance requires employers to post notices of the minimum wage rate at job sites. The ordinance authorizes the City to issue guidelines, investigate violations, hold administrative hearings and impose administrative penalties, including fines to help offset the City's enforcement costs. The ordinance also authorizes civil court actions against employers for violations of the minimum wage requirement."

The bully tried to claim his acerbic, sarcastic, patronizing and sometimes demeaning behavior was the result of his ADHD condition as an adult. The Ninth Circuit court of appeals saw through this facade and found he did not have a disability under the Americans with Disabilities Act. A police officer was treating others unkindly, repeatedly, he bullied them and the employer took action against him.

A police officer in South Carolina went above and beyond for a 13-year-old boy. The boy called police saying he was upset after fighting with his mother and that he didn't want to live there anymore. The officer who responded to the call went to the home and realized the boy didn't have a real bed. A few weeks later, the officer came back to the house with a truck full of gifts, including a TV, a Wii game system and a bed.

F. Lee Bailey is an attorney from whom I learned the most about how to be an effective trial attorney. I read all his books, and especially practiced his tips for cross-examination of witnesses.

Then he represented OJ Simpson and broke some of his own rules, such as always know the answer before you ask the question in court. I was surprised when he was asking questions that were not answered in a manner supportive of his client. Yet, I was not the expert, he was.

This article about his life, after learning about his recent death is insightful. Every attorney has good and not-so-good sides to their experience, and even more so, F. Lee Bailey. I am sure he could explain the reason for his actions that led to a contempt ruling, and I am sure he was used as a lesson to all attorneys by the Judges who harshly disciplined him. Nonetheless, there is much to be learned from this man and his books.

Every workplace around the world is in crisis or finding ways to change. You are not alone. Allow the crisis to push you outside your comfort zone into the creative zone as John Maxwell says.

One printing company changed the use of its equipment to make face shields for hospitals. They created a design, obtained approval from the hospitals and promptly kept their employees working diligently to make 5000-10,000 face shields each day!

Today I am giving back to the community by presenting under the direction of ADL and OC Jewish Bar Association before the administration and faculty of Mariners Elementary School to talk about bullying in the school climate. This is an excellent school, so giving them useful tips has caused me to really do my homework! I am thankful for the opportunity to be of service again.
