When one parent has historically made all major decisions for a child, and the other parent has had little involvement, it may be worth examining whether joint decision-making is actually practical.
These cases require evidence, realistic expectations, and a clear understanding of what is in the child’s best interests.

When there’s a documented history of domestic violence, joint decision-making may raise serious concerns. A plenary order of protection means a court has made findings following a hearing, not simply allegations.

In these circumstances, the question becomes: should a victim be required to make major parenting decisions jointly with the person who abused them?

These cases require careful consideration of the evidence and the child’s best interests.

Not every parenting disagreement needs to end up in court. But when serious concerns can’t be resolved between parents, litigation may be necessary.

This can include allegations or evidence of abuse or neglect, a documented history of domestic violence, one parent interfering with the other’s relationship with the child, or significant parenting-time disputes that cannot be resolved through communication.

Understanding when court intervention may be necessary can help parents make informed decisions about next steps. Learn more on our blog: kiswanilawfirm.com/blog/when-should-parenting-issues-be-litigated-in-a-divorce

Choosing a divorce attorney is an important decision, and it’s worth asking the right questions before you move forward.

Beyond experience and credentials, you’ll want to understand how the attorney communicates, how they approach your specific situation, what to expect throughout the process, and how fees and costs are handled. The right questions can help you better understand what to expect and find an attorney whose approach aligns with your needs. | kiswanilawfirm.com

Co-parenting can be difficult, especially when communication between parents is already strained. A few simple habits can help reduce conflict and create more consistency for your child:

• Keep messages short and factual
• Discuss the child, not the relationship
• Put agreements in writing
• Avoid using your child as a messenger
• Stick to the parenting plan
• Focus on consistency, not “winning”

The goal isn’t to make every interaction easy or to agree on everything. It’s to create as much peace, predictability, and stability as possible for your child.

Save this as a reminder for the moments when communication gets difficult.

Not agreeing with you doesn’t necessarily mean your spouse is refusing to cooperate.

During a divorce, both spouses have the right to their own position, even when they disagree. Refusing to cooperate generally involves something more than simply taking a different position in the case.

So, what actually qualifies as non-cooperation? We break it down in our latest blog.

What happens when one spouse refuses to cooperate during a divorce? While you can’t simply force someone to participate, the court has tools available to address non-cooperation.

If a spouse refuses to come to court, respond to pleadings, or participate in discovery, there may be options such as seeking a default judgment or asking the court for sanctions. Depending on the circumstances, sanctions can include attorney’s fees, barring certain testimony, or even striking pleadings.

The goal isn’t to punish someone, it’s to keep the case moving forward and encourage compliance with the legal process.

If your spouse is refusing to cooperate, an experienced family law attorney can help you understand what remedies may be available in your case.
