“I have a Will, so my family won’t have to go through probate.”
This is one of the most common estate planning misconceptions we hear.
A Will does not avoid probate. In fact, a Will is the document that guides the probate process by telling the court who should receive your assets.
If avoiding probate is one of your goals, additional planning may be needed, such as beneficiary designations, joint ownership arrangements, or a properly funded trust.
