Be VERY mindful before you decide to file an Asylum Application, especially one prepared by these notarios who come to your house and fill out applications.

I have come across many clients who filed these applications without understanding the consequences and ended up ruining their chances of being eligible for another legitimate immigration program.

USCIS is now issuing Notices to Appear (NTAs) to many affirmative asylum applicants and sending them to Immigration Court, sometimes WITHOUT even adjudicating the asylum application first.

And THIS is what is currently happening with asylum cases in Immigration Court:

In June 2026, 94.1% of the asylum cases decided by Immigration Judges were DENIED. Only 771 individuals were granted asylum.

Filing an Asylum Application is NOT something you should do simply because someone tells you it will get you a work permit. You need to understand what you are filing, whether you actually qualify, and the very serious consequences that can follow.

CONSULATE INTERVIEW CANCELATIONS!!

As most of you probably know by now, DOS suddenly cancelled many immigrant visa interviews, with no warning and initially no clear explanation as to why.

Now we are hearing that the cancellations are apparently so consular officers can undergo additional training on **public charge**.

This is just crazy and incredibly unfair. Some people had already left the U.S. for their interviews and are now stuck outside the country, not knowing when interviews will resume.

And the other big concern is that we really don't know yet how DOS is going to apply public charge after this training. There is still so much uncertainty about what this will actually mean for immigrant visa applicants.

Unfortunately, as unfair as it is, this is where we are right now. 😩

This is why it is really important that U.S. citizens register to vote and exercise their right to vote if they are troubled by this type of unfair treatment of people.

Matter of Arrabally and Yerrabelly has been OVERRULED!!!!!!!!!!!

This means DACA and TPS holders who accumulated unlawful presence before obtaining DACA or TPS may no longer be able to file for Adjustment of Status based on a parole entry if they do not have a U.S. citizen or lawful permanent resident spouse or parent who can serve as a qualifying relative for an unlawful presence waiver.

IMPORTANT: This new rule applies prospectively. Travel that occurred BEFORE 08/13/2026 remains protected under the prior rule. Applicants who already traveled before today can generally proceed as before.

This is another example of why it is NEVER a good idea to wait to apply for an immigration benefit that is available to you now. Immigration law does not stay the same. Things can suddenly become much more complicated and expensive, regardless of which administration is in office. Some very important immigration rules depend on case law, and as we saw today, longstanding case law can be overturned.

Those of you waiting for an interview at a U.S. Consulate abroad and wondering why it is taking so long...

This may help explain part of the reason.

According to the American Immigration Lawyers Association (AILA), the U.S. Department of State is facing widespread embassy vacancies and approximately a 20% workforce reduction. As a result, many consulates are experiencing longer visa processing times and fewer available interview appointments.

REMEMBER OUR WARNING... IT JUST HAPPENED AGAIN!!!!!!!!!!!

(ANOTHER ICE ARREST AT THE INDIANAPOLIS AIRPORT BEFORE A DOMESTIC FLIGHT)

Just a few days ago, we made a post warning everyone about the increasing risks of domestic air travel for certain noncitizens. Unfortunately, we have now learned of another incident.

According to reports from one of our immigration attorney colleagues, their client was apprehended and detained by ICE this morning at the Indianapolis International Airport while preparing to board a domestic flight to Atlanta for a family event.

The individual reportedly:

- Entered the U.S. on a B,2 visitor visa.
- Filed an affirmative asylum application within six months, before her authorized stay expired.
- Has a pending asylum application.
- Has a valid Employment Authorization Document (EAD).
- Has an Indiana driver's license.

To our knowledge, this is only the second or third reported ICE apprehension at the Indianapolis airport involving someone who entered lawfully on a visa and has a pending affirmative immigration benefit.

This is yet another reminder that having a pending application, a work permit, or a driver's license does not necessarily protect someone from being detained by ICE.

If you have any uncertainty about your immigration status or whether domestic travel is advisable in your particular situation, please speak with a qualified immigration attorney before you travel.

As always, every case is different, and no one should make decisions based solely on a Facebook post.

**(OTRA DETENCIÓN DE ICE EN EL AEROPUERTO DE INDIANÁPOLIS ANTES DE UN VUELO NACIONAL)**

Hace apenas unos días publicamos una advertencia sobre los crecientes riesgos de viajar en vuelos nacionales para ciertos inmigrantes. Lamentablemente, hoy nos enteramos de otro incidente.

Según informó uno de nuestros colegas abogados de inmigración, su cliente fue detenido por ICE esta mañana en el Aeropuerto Internacional de Indianápolis mientras se disponía a abordar un **vuelo nacional** con destino a Atlanta para asistir a un evento familiar.

Según la información disponible, esta persona:

* Ingresó a Estados Unidos con una visa de turista B,2.
* Presentó una solicitud de asilo afirmativo dentro de los seis meses de haber ingresado al país, antes de que venciera su período de estadía autorizado.
* Tiene una solicitud de asilo pendiente.
* Cuenta con un Documento de Autorización de Empleo (EAD) válido.
* Tiene una licencia de conducir del estado de Indiana.

Hasta donde tenemos conocimiento, este sería apenas el segundo o tercer caso reportado de una detención por parte de ICE en el Aeropuerto de Indianápolis de una persona que ingresó legalmente con una visa y que tiene un beneficio migratorio afirmativo pendiente.

Este caso nos recuerda, una vez más, que **tener una solicitud migratoria pendiente, un permiso de trabajo o una licencia de conducir no significa necesariamente que una persona esté protegida contra una detención por parte de ICE.**

Si tiene alguna duda sobre su situación migratoria o sobre si es recomendable viajar dentro de Estados Unidos en su caso particular, **consulte con un abogado de inmigración antes de viajar.**

Como siempre, cada caso es diferente y nadie debe tomar decisiones basándose únicamente en una publicación de Facebook.
