Temporary Emergency Rules on Evictions, Foreclosures Set to End at Midnight Sept. 1 After Judicial Council Vote

The Judicial Council has voted to end Emergency Rules on Evictions starting September 1, 2020. Starting September 1, 2020, summons can be issued on all unlawful detainers. There are also COVID-19 moratoria that landlords should be aware of.

Los Angeles County extended the eviction moratorium and rent freeze through July 30, 2020. The eviction moratorium applies to all of unincorporated Los Angeles County and to cities that do not have a current eviction moratorium in place. The rent freeze applies to unincorporated Los Angeles County.

Pacific Legal Foundation represents two plaintiffs who have filed an action against the Judicial Council for Emergency Rule No. 1 which prohibits issuing summons on nearly all unlawful detainer complaints until 90 days after the Statewide State of Emergency is lifted. This decision is more far reaching than any local moratorium.
