The exculpatory clause did not save the trustee.

Trust documents and terms of use are often drafted to shield a trustee from liability. A Virginia court recently made clear that boilerplate has a ceiling.

In Eastern Point Trust Company v. Pitt, McGehee, Palmer, Bonanni & Rivers, the trustee pointed to broad exculpatory language and argued the claims against it could not proceed. The court disagreed as to the fiduciary duty and trust claims.

The reason is statutory. Virginia Code § 64.2-799(A)(1) provides that a trustee is not relieved of liability for a breach of trust committed in bad faith or with reckless indifference to the purposes of the trust or the interests of the beneficiaries.

What does that mean for a family?

If a trustee has favored itself, ignored the terms of the trust, or refused to account, language in the paperwork that appears to waive liability is not the end of the conversation. It is the start of a specific legal question: what conduct is alleged, and does the clause actually reach it?

The record decides that. Trust instruments, statements, accountings, correspondence, and the trustee's own internal records are what show intent. They also become harder to reconstruct with time, and the Trust Code has its own deadlines.

If you are dealing with a trustee who will not account, or a family member abusing a position of trust, contact us.

Virginia’s estate-planning landscape changed on July 1, 2026, when SB 540 took effect.

For trust contests involving undue influence, Virginia law now provides a statutory presumption that can materially change how the case is litigated. When the presumption arises, the fact-finder must presume undue influence unless the evidence shows that the decedent intended the property to be transferred as stated in the contested trust instrument.

The legislation also affects estate administration. Among other changes, it:

• Expands the Small Asset Affidavit process for qualifying personal assets, including assets valued at $75,000 or less and subject to statutory timing and successor requirements.

• Provides surviving spouses with longer windows to claim a family allowance and exempt property.

These changes make early investigation more important, not less. The trust documents, medical records, financial records, caregiver relationships, communications, and evidence of the decedent’s intent may all become central to the outcome.

At Smith Trial Law, fiduciary and estate litigation is one of our two practice pillars. We are a trial firm that has argued and won before the Supreme Court of Virginia in trust and estate litigation.

This post is for general information only and is not legal advice. If you are involved in a trust contest or fiduciary dispute, the applicable deadlines and evidence should be evaluated promptly.

Ranger did this. I had to get lids on all trash cans. I would take them all off and just deal with it every day just to have him back.
