Your divorce is final. But has your 401(k) division actually been completed?

A recent Kiplinger article highlights an easily overlooked detail: being awarded retirement money in a divorce agreement does not mean those funds have automatically been transferred.

For many employer retirement plans, including 401(k)s, a Qualified Domestic Relations Order, or QDRO, is needed to carry out the division.

If your settlement includes retirement benefits, ask:
✅ Has the required order been prepared?
✅ Has it been entered by the court?
✅ Has the retirement plan reviewed and approved it?

These steps matter to your financial future.

At Elite QDRO Consulting, we help individuals and attorneys with QDRO preparation and review nationwide. Whether you’re working through a divorce or still have retirement paperwork to finish, we’re here to help.

An old job could mean a retirement account you’ve forgotten about.

When preparing for divorce, it’s easy to focus on the 401(k) tied to a current employer. But what about the account from a job five or ten years ago? Or a pension from an earlier career?

Before working through retirement division, take time to put the full picture together:

✅ List current and former employers
✅ Gather statements for each retirement account
✅ Check for pension benefits from previous jobs
✅ Share that information with your attorney

You don’t have to figure everything out at once. Having the right information is a good place to start.

At Elite QDRO Consulting, we help individuals and attorneys with QDRO preparation and review so they can move forward with one less thing on their plate.

Recently divorced? This is one loose end you don’t want to overlook.

A recent article from the American Bar Association highlighted an important issue that we see far too often after divorce:

Dividing a retirement account in your divorce agreement does not necessarily mean the retirement account has actually been divided.

If a 401(k), pension, 403(b), or other employer sponsored retirement plan was awarded to a former spouse, additional steps may still be required to complete the transfer. In many cases, that means preparing and submitting a Qualified Domestic Relations Order, or QDRO.

The ABA article also points out why waiting years to handle the retirement transfer can create problems. Accounts can change, participants can retire, and the process can become much more complicated.

If your divorce is already final, one question worth asking is:

“Was my retirement division actually completed?”

At Elite QDRO Consulting, we help individuals and attorneys prepare and review QDROs nationwide.

💡 DID YOU KNOW? A QDRO can involve more than just dividing the retirement account.

When a pension is involved in a divorce, there’s another important issue that sometimes gets overlooked:

Survivor benefits.

Depending on the retirement plan and the terms of the divorce, a QDRO may provide that a former spouse is treated as the participant’s surviving spouse for some or all of the applicable survivor benefits.

Why does that matter?

With certain pension plans, what happens if the participant passes away can depend heavily on how the QDRO was written.

That means simply saying:

“My ex gets 50% of my pension”

may not answer every question that needs to be addressed.

You may also need to consider:

• What happens to the former spouse’s benefit if the participant dies first?

• Is a survivor benefit available under the plan?

• Was the former spouse awarded survivor protection in the divorce agreement?

• How does the plan require that protection to be addressed in the QDRO?

📌 Every retirement plan is different.

This is another reason it’s important to review the actual plan requirements instead of assuming all QDROs work the same way.

What happens if your 401(k) goes up or down before the QDRO is processed?

This is an important detail that can sometimes get overlooked during retirement division.

Imagine a divorce agreement awards a former spouse 50% of a 401(k) balance as of a specific date.

The QDRO isn’t completed until several months later.

During that time, the investments inside the account may have gained or lost value.

So who gets those gains or absorbs those losses?

It depends on the language of the divorce agreement, the QDRO, and what the retirement plan allows.

For example, an award might be written as:

📌 50% of the account as of a specific date, adjusted for investment gains and losses until the date of distribution

Or the agreement may provide for a specific dollar amount without the same type of adjustment.

That difference can matter, especially when a significant amount of time passes or the market moves substantially.

This is one reason the details of a QDRO are so important. It’s not always as simple as saying, “She gets 50%” or “He gets $50,000.”

The calculation method matters too.

If you’re going through a divorce involving a 401(k) or other retirement plan, make sure you understand exactly how the award is supposed to be calculated.

💡 DID YOU KNOW?
A QDRO doesn’t always mean your ex receives 50% of your entire 401(k).
One of the biggest misconceptions about QDROs is that retirement accounts are automatically divided 50/50 in divorce.
That’s not necessarily the case.
A divorce decree or settlement agreement might award:
• 50% of the account earned during the marriage
• A specific percentage of the account
• A specific dollar amount
• A percentage calculated between certain dates
• An amount that may be adjusted for investment gains or losses
For example, if someone had $75,000 in their 401(k) before the marriage, the divorce agreement may only divide the portion accumulated during the marriage rather than the entire account.
📌 The wording matters.
The QDRO generally needs to reflect what was actually awarded under the divorce judgment or settlement agreement while also complying with the retirement plan’s requirements.
That’s why two people with similar 401(k) balances can end up with very different QDRO calculations.
Did you already know this, or did you think retirement accounts were automatically split 50/50? 👇

Your divorce says you’re getting $50,000 from your ex’s 401(k). But will you actually receive $50,000?
This is where gains and losses can become important.
Let’s say your divorce was finalized two years ago and you were awarded $50,000 from your former spouse’s 401(k). The QDRO still hasn’t been completed.
During those two years, the investments connected to that portion of the account may have increased or decreased in value.
Depending on the language in your divorce judgment, the QDRO, and the retirement plan’s procedures, the amount ultimately transferred to you may be adjusted for those investment gains or losses.
That means a $50,000 award from two years ago may not necessarily equal a $50,000 transfer today.
This is one of the reasons the wording used when dividing retirement benefits matters so much.
At Elite QDRO Consulting, we review the divorce documents and the retirement plan requirements so the QDRO accurately reflects the award and addresses important issues like the valuation date and the application of gains and losses.
