The Department of Labor has finally issued the new Regulations regarding overtime and the minimum amount an employer must pay an employee for the employee to be exempt from overtime (hint...it has been raised from $23,660 to $47,476). It has been a while since we last posted, but as part of our New Year's resolution, we are going to try to post something employment law related at least once a month! For January, we wanted to tell you that those pesky NLRA right to unionize posters that the NLRB attempted to require PRIVATE employers to post are no longer at issue (translation: Employers do NOT have to post that poster). The NLRB decided not to appeal the ruling that held that the NLRB exceeded its authority when it attempted to require private employers to post this information. So, the saga of the "are they required or are they not required" NLRB posters is now, officially, at an end....until the NLRB decides to revisit this issue at a later date. In case you didn't hear, an employer requirement of the Patient Protection and Affordable Care Act (Obamacare) is coming up next week. The Act requires employers to distribute one of the two “Model Affordable Health Care Notice” forms to all employees by October 1st.

While the Department of Labor has agreed not to fine or penalize a company for failing to provide these notices, compliance is still recommended as it is required under the explicit language of the Act and is the prudent thing to do.

Companies may want to contact their insurance agents directly as they will have the necessary information about your insurance plan to help you complete the notice form. If you need assistance, please call the office!

I just received an email that asked the question "Are handbooks really necessary?" As an employment lawyer, I will tell you "yes" and give you all the legal reasons why. As a former HR practitioner, I will tell you "yes" and tell you how important they are when assessing employee problems/questions and how they helped me do my job consistently. As an employee, I will tell you "yes" and explain how they helped me learn what a new employer's rules/expectations are - down to simple things like what holidays I have off. Handbooks are not only great tools, but are essential in any business. What do you think?

64% of employees are checking non-work related websites during work time. What is your company's philosophy on non-work related internet usage? Not sure? Check your employee handbook or policy. If your policies and procedures do not address internet usage, how are your employees supposed to know what is acceptable and unacceptable? If your company is using background checks, the case of the EEOC v. Freeman (out of the District Court of Maryland), is a GREAT case showcasing an employer that was utilizing background checks appropriately and decided to fight back against the EEOC when the EEOC brought a lawsuit against it. The court held that the "careful and appropriate use of criminal history information is an important, and in many cases essential, part of the employment process of employers throughout the United States.” The court dismissed the EEOC's claim that Freeman's use of criminal background checks had a disparate impact on minority applicants - calling the EEOC's assertions laughable!
