On March 9, 2015, the U.S. 4th Circuit Court of Appeals denied the motion by Triple Canopy Inc. for a rehearing en banc. Unless Triple Canopy Inc. appeals to the U.S. Supreme Court, the case will now resume in the U.S. District Court, Eastern District of Virginia. We are pleased that our client, Omar Badr, on behalf of and in conjunction with the United States of America, will get his day in court.

The U.S. 4th Circuit Court of Appeals rules in favor of the Justice Department and Day & Johns client, Omar Badr, in reversing a ruling dismissing a False Claims Act Complaint against Triple Canopy Inc for allegedly falsifying qualifications for guards at a US airbase in Iraq - "The FCA is “strong medicine in situations where strong remedies are needed.” Owens, 612 F.3d at 726. That strong remedy is needed when, as here, a contractor allegedly engages in a year-long fraudulent scheme that includes falsifying records in personnel files for guards serving as a primary security force on a United States airbase in Iraq."

A federal judge will decide next week whether the U.S. National Slavery Museum’s largest creditor can move forward with a lawsuit involving deed restrictions on the museum’s property.
