😔 In Florida, grandparents have almost NO automatic legal right to see their grandchildren — even if something happens to both parents.
This is one of the most heartbreaking situations I see as an estate planning attorney. And most families have absolutely no idea until it’s too late.
Here’s the reality 👇
If both parents pass away without a will or estate plan that names a guardian and specifically addresses grandparents’ rights — a judge decides everything.
And in Florida, that judge is not legally required to consider the grandparents at all.
That means the grandparents who showed up to every birthday, every school play, every holiday — could be completely cut out. Not because anyone wanted that. But because nothing was ever put in writing. 💔
