Good news out of the Supreme Court today. The Court has ruled that the bankruptcy code allows for discharge of debts owed to tribal lenders. This decision resolves-in favor of consumers-a split in decisions among lower courts on the issue.
Tribal lenders have historically charged outrageous interest rates on personal / payday loans--sometimes in the range of 500%. They do this by incorporating on tribal land and claiming sovereign immunity from laws limiting interest rates and collection practices.
The US Supreme Court decided TODAY that the bankruptcy code unequivocally abrogates sovereign immunity. This means that there is no question that debts to tribal lenders are dischargeable in bankruptcy, and that tribal lenders are subject to the automatic stay imposed under the bankruptcy code. So they cannot continue to pursue collection actions after a bankruptcy case is filed.

People often ask us if they will lose their tax refund in a bankruptcy.
The best answer to this question is: It depends.
Certain tax credits are protected by exemptions in bankruptcy. For example, if your refund is based on the Earned Income Credit or the Additional Child Tax Credit, the amount associated with those credits cannot be taken by the trustee. Similarly, the trustee cannot reach refunds based on Recovery Rebate Credits (associated with Covid relief).
If your refund is based simply on overpayments to the IRS or State tax authorities, the refund is not protected by an exemption, and the trustee can reach those funds. If you are in a chapter 7 case, the trustee will take those funds to distribute among your creditors. If you are in a chapter 13 case, the trustee may (or may not) have a policy by which you agree to turn over a portion of the non-exempt refund and keep the rest.

A lot of people worry about losing their car in bankruptcy. In most cases, you can keep your car in either chapter 7 or chapter 13 bankruptcy. The bankruptcy code allows an individual to protect up to $4,000 in equity in a car. If you are married and you both file, you and your spouse can combine this exemption to protect up to $8,000 of equity in a car.
A chapter 13 bankruptcy allows you to keep the car and catch up on past-due payments over the course of 3-5 years. In some cases, you can even pay the car off over the course of the 3-5 year plan. In addition to that, in some cases, you can reduce high interest rates and pay the car off for less than what you actually owe on it.
A chapter 7 bankruptcy allows you to choose one of 3 options: redeem the car, enter into a reaffirmation agreement with the lender to continue paying on the loan after the bankruptcy, or surrender the car.

Chapter 13 Bankruptcy
Think of a Chapter 13 bankruptcy case as a bill consolidation plan that imposes a settlement of your debt on your creditors. In a Chapter 13 case, you pay a single monthly payment to the Chapter 13 Trustee, who then distributes the payment among your creditors.
Your monthly payment amount is determined by subtracting your necessary expenses from your monthly income. The “disposable income” that is left over after paying your necessary expenses is what you pay to the Bankruptcy Trustee. Under this plan, you never pay any creditor more than you can afford to pay, and you never need to “rob Peter to pay Paul.” That is, you never need to sacrifice on one bill to pay another.
We will help you develop a chapter 13 payment plan through which your creditors are paid at least a portion of what you owe over the course of a 3 - 5 year plan. At the end of the 3-5 year plan, any debt that remains on things like credit card bills, medical debt, payday loans, debt from repossessed vehicles, etc. is discharged as it would be under a Chapter 7.

Chapter 7 Bankruptcy
A Chapter 7 bankruptcy provides for a complete discharge of eligible debt through a liquidation of your non-exempt assets. Under a Chapter 7 bankruptcy, the bankruptcy trustee can take any asset that is not protected by an exemption and sell it to generate money that is used to repay some portion of your debts to your creditors.
The law provides important exemptions that protect equity in your home, cars, household goods, work tools and other assets. These exemptions allow most people to complete a bankruotcy while keeping their homes, cars, and many other assets.

Many prospective clients are curious as to how a bankruptcy will impact their credit. Many are worried that they will never be able to get credit again, and therefore never be able to buy a car or a home after filing bankruptcy. This just isn't the case.
Generally, a chapter 13 bankruptcy will stay on your credit report for 7 years. Chapter 7 tends to stay on for 10 years. That time is measured from the date of filing.
It generally takes 4-6 months to get a discharge in a chapter 7 case, So, if you file a chapter 7, you can expect the bankruptcy to appear on your credit report for around 9.5 years after your discharge.
A chapter 13 case takes anywhere from 3 to 5 years to complete, depending on your income level. So a chapter 13 bankruptcy will appear on your credit report for 2-4 years after you receive a discharge.
Individual delinquent accounts may disappear from your credit report sooner than your bankruptcy does. This is because each individual delinquent account will remain on your report for a total of 7 years from the date that it first became delinquent. So if you have accounts that are delinquent before the bankruptcy, they could fall off of your report before the record of the bankruptcy is removed.
In terms of how the bankruptcy affects your credit score, any bankruptcy will have a negative effect on your score. However, the extent of the effect will depend on what your score is before the bankruptcy. If you have a high score going in, bankruptcy will have a much larger effect on the score. If you have a lower score going into the bankruptcy, then filing is not likely to have a drastic effect on your score.
It is not impossible to rebuild your credit after a bankruptcy, and there are companies that will work with you to re-establish your credit after you file. How fast you rebuild your credit generally depends on how fast you can establish a positive payment history for accounts that appear on your credit report.
This can be more difficult to do in a chapter 7 because, while there are companies that will work with you, it may be difficult to get multiple accounts opened after a chapter 7.
Rebuilding credit is easier in a chapter 13 bankruptcy because chapter 13 involves a payment plan in which your existing creditors continue to get at least partial recurring payments. This helps to re-establish a positive payment history on more accounts that appear on your credit report, thereby improving your score more quickly.
