If you want to have a chance at winning your case for Social Security disability, I highly recommend you schedule a consultation with Elizabeth Smith. It's discouraging to receive that first denial, but Elizabeth can tell you if you have a case. If she agrees to represent you, she'll explain how everything works and guide you to receiving a fully favorable decision. Don't try to do this on your own, and don't go to an attorney who doesn't specialize in Social Security cases. Here's a great post from Attorney Jeffery Delott about treatment records.

I received a fully favorable decision today from Administrative Law Judge (“ALJ”) Weiss on another federal court remand involving a police officer. The claimant’s doctors concluded that the he lacked the ability to perform sedentary work. The ALJ had Gerald Greenberg testify as a medical expert ("ME"), and he concluded the claimant could do sedentary work.

The cross exam of the ME, who testified the treating doctors’ opinions were inconsistent with their treatment notes, was critical. I was able to get the ME to admit that the treating doctors’ opinions were based on diagnostic testing, and that there were objective clinical signs that supported the diagnoses. More importantly, I got the ME to admit that the purpose of treatment notes is not to provide evidence for a disability matter, which would explain differences between the notes and disability reports. ALJ Weiss accepted the opinions of the treating doctors over ME Greenberg because the former were “consistent with the diagnostic tests, clinical signs and the record as a whole.”

This matter reflects a critical issue when dealing with disability claims. Treatment notes basically serve as a way to remind the physician of things she or he may need to remember at a follow up visit. Many relevant physical exam findings are not included either because, for example, they may have been previously reported and would be redundant, are obvious such as walking with a cane, or are implied, such as trigger points for fibromyalgia. Claims adjudicators frequently try to deny a claim by relying on treatment notes’ omissions as evidence that a person lacks “objective evidence” to support a claim. Therefore, it needs to be pointed out that treatment notes do not serve the same purpose as a narrative or other disability report, which is why they may appear different.

The Butler County Bar Association has requested that I again present the CLE Bridge the Gap to new attorneys. Honored to be asked - and so enjoy working with newly admitted attorneys. It will be presented on June 21, 2019.

Newly admitted lawyers are required to complete an approved Bridge the Gap program as part of their initial CLE requirement. The program offers four (4) hours of ethics credits and are provided by Accredited Providers of CLE.

Warning Signs for SSA FRAUD

You get an unsolicited call from someone claiming to work for SSA. Except in rare circumstances, you will not get a call from Social Security unless you have already been in contact with the agency.
The caller asks for your Social Security number — again, something an actual SSA employee wouldn’t do.
A call or email threatens consequences, such as arrest, loss of benefits or suspension of your Social Security number, if you do not provide a payment or personal information.

Do's

Do hang up if someone calls you out of the blue and claims to be from SSA.
Do be skeptical if a caller claims to be an “officer with the Inspector General of Social Security.” Scammers appropriate official-sounding and often actual government titles to make a ruse seem authentic.
Do set up a My Social Security account online and check it on a monthly basis for signs of anything unusual, even if you have not yet started collecting benefits.
Do install a robocall-blocking app on your smartphone, or sign up for a robocall-blocking service from your mobile network provider.

Don'ts

Don’t call a phone number left on your voice mail by a robocaller. If you want to contact SSA, call the customer-service line at 800-772-1213.
Don’t assume a call is legitimate because it appears to come from 800-772-1213. Scammers use “spoofing” technology to trick caller ID.
Don’t give your Social Security number or other personal information to someone who contacts you by email. SSA never requests information that way.
Don’t click links in purported SSA emails without checking them. Mouse over the link to reveal the actual destination address. The main part of the address should end with “.gov/” — including the forward slash. If there’s anything between .gov and the slash, it’s fake.

SSA PHONE SCAM ALERT 2019

As talked about today on Butler Radio Station WISR here is information about reporting fraudulent calls. Please talk to individuals who may be susceptible to such calls.

The Social Security Administration said that they will never threaten or promise a Social Security benefit approval or increase in exchange for information. In those cases, the call is fraudulent, and people should just hang up.If you receive these calls, you are asked to report the information to the Office of the Inspector General at 1-800-269-0271. Below is an example of what the SSA phone scam sounds like.
