Gestational surrogacy, when done ethically, transparently, and with strong legal protections in place, is not “modern-day slavery.”
It is women making informed choices about their own bodies, their own lives, and their own ability to help create families.
The recent statements coming from the Florida Attorney General are not only deeply harmful to the surrogacy community, but dangerous to the broader conversation surrounding bodily autonomy and reproductive freedom. Words matter. And comparing carefully screened, fully consensual surrogacy arrangements to human trafficking ignores the reality of what ethical surrogacy actually looks like.
At its core, ethical surrogacy is built on consent, education, independent legal representation, medical and psychological screening, and the right of all parties to make informed decisions every step of the way. Surrogates are not powerless. They are strong, thoughtful women who deserve respect, not rhetoric that diminishes their agency or autonomy.
Families are built in many different ways. Protecting the right of people to choose how and when they build those families matters. Protecting a woman’s right to decide what she does with her own body matters.
At DBR Law, we will always advocate for ethical practices, compassionate protections, and the right of individuals to make deeply personal reproductive choices free from fear, stigma, or political attacks.
