At the beginning of last week, I was contacted by a nice lady who'd been in an accident and hadn't been hurt. Even though I don't generally handle cases without injury, I heard her out.

For one, even if I can't help someone on a particular case, I make sure to hear them out and explain myself so they understand and don't feel ignored. That way, if they are ever injured, perhaps they'll remember the lawyer who took the time to listen.

For two, if there is not an injury, but the accident is the result of a crime/infraction (like hit-and-run) or, particularly, a DUI, I can 100% attempt to help recover not just the money to get the property damage claim resolved, but negotiate for additional punitive damages that may be in play.

The nice lady appreciated me listening to her because the other attorneys she'd looked up had all told her they wouldn't represent her because she hadn't been hurt. She was frustrated because they hadn't listened to her.

I listened and it turned out her car had been damaged by a drunk driver who'd fled the scene. I signed her two hours after she called me on June 17th and we settled her claim today for a significant multiplier over her property damage.

Follow-up to the post last month where I was able to get the full liability policy for a client after I took over her case from another attorney who was not able to get an offer over her medical bills:

Originally, the client insisted she had Underinsured Motorist (UIM) Coverage. I requested the Declarations Page from her insurer and they showed that she had it currently. I double checked that she had it on the date of the accident, and they showed me the older "dec page" that showed she did *not* have it.

Considering the extent of her injuries, that was a big problem. Fortunately, South Carolina law requires insurers to show where their customers have denied coverage. I asked them to provide that proof.

The next time they got back to me they apologized, said there'd been a big mistake, and sent me the proper declarations page showing she *did* in fact have the coverage on the date of the accident.

Today, her underinsured motorist insurance carrier called to say they were tendering that full policy as well. Woot! Woot!

Took over an auto-wreck case from another attorney because low property damage didn't jibe with the severity of the injuries. Lady came to me through a friend/former client. The original offer was over a year ago and was for less than the medical bills. Just got them to agree to tender the policy so I could go after underinsured motorist coverage.

Sometimes you're having supper with friends and you get a phone call and the next thing you know you're running to your office and throwing on a suit and going to sign a client at the hospital.

It can be very frustrating to have to wait to wrap up a claim/case when you have substantial injuries. When I was in a boating accident that required me to have nerve reattachment surgery and 15 months of physical therapy, I couldn't begin to negotiate my claim for eighteen months.

I just settled the liability portion of a car accident case for a client who was injured eighteen months ago. We could have settled it prior, of course, and the client certainly felt the financial pressure to do so, but we would have simply paid the medical bills and that would be that. Now, because my client was patient and followed the process of getting all the doctors' recommendations, we will be able to make a strong case for significantly more money from the underinsured policies on the household's cars.

Patience is a virtue that pays in personal injury cases.


Just got a call from a gentleman who was rear-ended by a Mack truck yesterday, along with a pair of friends in the car with him. I was referred to him by a former client. I'm heading out to speak with them this evening.

It's extremely important to contact an attorney as soon as possible after you've been in an accident. Most people aren't money-grubbing or litigious. They think they're doing the right thing by not getting a lawyer or not going immediately to the doctor or emergency room and seeing if it'll turn out they're not that hurt.

What tends to happen to those people is that it takes days for all their symptoms to manifest and, then, when they finally are forced to seek treatment, the insurance company reduces its offer to them (or sometimes refuses to accept liability at all) because the insurance company says that an intermediary event could have caused that injury (eg maybe they fell at home). Those folks then end up paying for "doing the right thing."

Progressive Insurance just settled a case with me for an objectively reasonable amount and didn't force me to sue them.


Progressive is ordinarily the bane of my existence. They'll usually start at offers so low they're insulting and then make you pull teeth to merely get to awful.

Whatever they put in their coffee today to make them be reasonable, I hope they dump more in the pot going forward.
