A manmade pool can support an injury claim. A natural pond usually can't.
Under Georgia's attractive nuisance doctrine, courts generally require the dangerous condition to be artificial rather than natural. This distinction matters in Cu***ng, where both backyard pools and natural water features are common across residential properties.
Georgia law also requires pool fencing at least four feet high, with specific alarm requirements if a house wall serves as part of the barrier. When these standards aren't met and a child is injured, property owners can face liability.
