Una importante decisión con carácter de precedente fue emitida hoy. La Junta de Apelaciones de Inmigración (BIA) dictaminó que viajar al extranjero bajo una autorización de *advance parole* constituye una "salida" a efectos de la sección 212(a)(9)(B)(i)(II) de la Ley de Inmigración y Nacionalidad (INA). Esta decisión significa que viajar con *advance parole* ahora puede activar las penalizaciones de 3 o 10 años por presencia ilegal si la persona ha acumulado previamente dicho periodo de presencia ilegal.

A significant decision establishing a precedent was issued today. The Board of Immigration Appeals (BIA) ruled that traveling abroad under *advance parole* authorization constitutes a "departure" for purposes of Section 212(a)(9)(B)(i)(II) of the Immigration and Nationality Act (INA). This decision means that traveling with *advance parole* can now trigger the 3-year or 10-year penalties for unlawful presence if the individual has previously accrued such a period of unlawful presence.

CHANGE IN AFFIRMATIVE ASYLUM PROCESSING:

USCIS currently resolves "affirmative" asylum applications from aliens who are not in removal proceedings. USCIS usually resolves the application or refers it to an immigration judge. This allows the alien to have a second chance to obtain asylum.

The NEW RULE allows USCIS to refer asylum applications to immigration judges without interviewing the alien. The new rule will take effect immediately.

CAMBIO EN PROCESAMIENTO DE ASILOS AFIRMATIVOS:

Actualmente USCIS resuelve las solicitudes de asilo "afirmativo" de extranjeros que no se encuentran en procesos de expulsión. USCIS generalmente resuelve la solicitud o la remite a un juez de inmigración. Esto permite que el extranjero tenga una segunda oportunidad para obtener el asilo.

La NUEVA REGLA permite al USCIS remitir las solicitudes de asilo a los jueces de inmigración sin entrevistar al extranjero. La nueva norma entrará en vigor de inmediato.

La decisión de hoy de la Corte Suprema pone fin a la protección del Estatus de Protección Temporal (TPS) para los ciudadanos haitianos y sirios.
En una decisión tomada por 6 votos a favor y 3 en contra, la Corte Suprema de los Estados Unidos dictaminó que la administración tiene la facultad —no sujeta a revisión judicial— de cancelar el Estatus de Protección Temporal.
Está previsto que la decisión entre en vigor oficialmente unos 32 días después del fallo, lo que dará tiempo a las agencias para iniciar la eliminación gradual del programa.

n a 6-3 decision, the U.S. Supreme Court ruled that the administration has unreviewable authority to terminate Temporary Protected Status
The decision is scheduled to officially go into effect roughly 32 days following the ruling, giving agencies time to initiate the phase-out of the program.
