Many Americans do not know, or refuse to accept, the facts surrounding their potential need for long-term care and the costs associated with it. According to a 2015 Genworth survey, 70% of Americans over the age of 65 will eventually need some type of long-term care.

To add, this study showed a lack of understanding by Americans of coverage for long-term care by Medicare, Medicaid, and private health insurance. The truth is that Medicare does not pay for ongoing long-term care.

The average annual cost for long-term care in Pennsylvania is in excess of $125,000.00. Most Americans are unprepared for the costs associated with long-term care.

Failing to prepare for these costs can cause a family to unnecessarily spend down their assets. Our attorneys can help you plan for this extensive expense. This type of planning is referred to as "Asset Protection Planning," or commonly referred to as "Proactive Planning."

Asset Protection Planning is a type of estate planning that is designed to allow people to qualify for Medicaid without losing most, if not all, of their resources. We use special planning techniques to make appropriate transfer at least five years before applying for an institutional level of care benefits. Tip #1 Acknowledge that you're not alone. A lot of families face this burden every day. In fact, more than 1 in 3 Americans over the age of 65 will probably require a nursing home level of care at some point.

Tip #2 Plan Ahead. It pays to be proactive. Learn about the services that assisted living facilities and nursing homes can provide. This will help you to determine the appropriate care setting for your parent. Reach out to several facilities in your area and ask for a tour. Observe how the staff interacts with their residents. Pay attention to how urgently staff members react to situations. We offer a Nursing Home Checklist as a resource to our clients. Every single person over the age of 18 should have a Power of Attorney. You never know when something catastrophic may happen.

You need to have a plan in place to take care of you in the event you become unexpectedly incapacitated. If you do not have these documents in place then you have no control who will be making decisions on your behalf.

It can be expensive and time consuming for your loved ones to go through the court to have a guardian appointed by a judge if a proper Power of Attorney is not in place.

Power of Attorney documents are absolutely essential documents that everyone should have. It is important to consult an elder law attorney who can examine your unique situation to create your Power of Attorney and to keep it updated.
