To anyone interested in special education and school disciplinary matters:

I will be giving the morning half of the Maryland Special Education Law seminar offered by the National Business Institute in June this year. My partner, Diana Savit, will be giving the afternoon part of the seminar. The seminar will be held on June 4, 2013 in Rockville, Maryland, and on June 6, 2013 in Baltimore, Maryland.

I will be speaking on special education and disciplinary maters for special needs students and will cover topics including: Section 504 of the Rehabilitation Act, Title II of the Americans With Disabilities Act (ADA), Individuals with Disabilities Education Act (IDEA), Free Appropriate Public Education (FAPE), Individualized Education Program (IEP), recent developments in special education law, Manifestation Determination Reviews, Ten-Day Rule and “Stay Put” during Due Process.

Supreme Court To Take On Gay Marriage

The Supreme Court announced today that it will hear cases on the Defense of Marriage Act (DOMA) and California's Proposition 8 law. See: http://www.huffingtonpost.com/2012/12/07/supreme-court-gay-marriage_n_2218441.html

The United States Supreme Court will review the decision by the 9th U.S. Circuit Court of Appeals that struck down Proposition 8, a 2008 law which banned gay marriage in California. The appeals court's ruling issued was issued in February and found the law unconstitutional.

Congratulations Maryland!

Maryland and Maine became the first states to legalize same-sex marriage by popular vote. Currently, same-sex marriages are also legal in Connecticut, Iowa, Massachusetts, New Hampshire, New York, Vermont and Washington D.C.

The Maryland law will go into effect on January 1, 2013. Maryland's marriage equality will mean that:

● Same-sex parents will be able to provide their children with the security of legal marriage.

● Same-sex married couples will have the same inheritance rights as heterosexual married couples.

● An individual in a same-sex marriage will have the same right to include his or her spouse on health insurance as an individual in a heterosexual marriage.

● An individual in a same-sex marriage will have the same right to visit his or her spouse in the hospital as an individual in a heterosexual marriage.

● An individual in a same-sex marriage will have the right to recover for the wrongful death of his or her spouse, and to claim loss of consortium in personal injury and medical malpractice cases.

● Same-sex married couples will be entitled to seek the same relief and protection as straight married couples upon divorce, including property distribution and alimony.

The Maryland law does not require clergy to perform same-sex marriages, or recognize same-sex marriages within the context of their religious beliefs.

There's a new decision about federal privacy rights, adultery and email hacking and snooping. A South Carolina state court held that a woman who gained entrance to her father-in-law's email account (by guessing the answer to his security question) did not violate the federal 1986 Stored Communication Act or violate her father-in-law's privacy because the emails she read were stored in his inbox.
