Pretty important ruling coming from SCOTUS today! SCOTUS unanimously ruled that the government can not prosecute someone for illegal possession of a firearm simply because they are also in possession of ma*****na ruling it is a violation of the Second Amendment!

While the government has a right to defend it's policies, constitutional law prohibits our government from using it's official power to retaliate against, penalize, or financially damage entities for exercising protected speech. Using government resource such as this to formally blacklist specific journalist and news organizations crosses the line from "counter-speech" to official retaliation and coercion.

The First Amendment is under attack when government actions discourage citizens or organizations from exercising their constitutional rights out of fear of state sanctions, loss of credentials, or public targeting.

Having the White House create a formal list of "media offenders" creates a powerful deterrent against aggressive investigative journalism. Its a signal that any adverse opinion to the president or the current administration will result in official governmental blacklisting. The First Amendment strictly, and very clearly bars the government from penalizing speech.

One of the most fundamental principles in American democracy is that the press functions as an independent watchdog--often referred to as the Fourth Estate--meant to check government power and hold our elected officials accountable to the public who they serve.

Historically, state-run registries that label independent journalists as "enemies," "offenders," or "foreign agents" are hallmarks of authoritarian regimes rather than liberal democracies. Utilizing the immense, centralized platform of the White House to systematically undermine the credibility of the free press mimics tactics used abroad to erode democratic institutional checks and balances.

American political norms dictate a clear separation between political campaigns and the objective administration of the federal government. Using taxpayer-funded executive branch websites and personnel to engage in partisan media warfare or to attack specific private corporate entities violates the traditional, non-partisan boundaries expected of official state communications.

Let us not become so complacent that we accept this as normal.

It doesn’t matter if it will only affect one or many defendants. It’s a matter of affecting constitutional rights. But Villio also indicated she’s not there to determine if a law is constitutional or not on a separate issue on a separate bill. Giving power of defendant rights over to the very people who are prosecuting them is what we are talking about here.

There was a lot more said that the news don’t cover, like how defendants don’t get to forum shop or judge shop bc they are already randomly allotted a judge based on the date of their offense. We only have two lawyers on this committee. One who is a lifetime prosecutor and one who practices in civil court. We need more representation here. This is a horrible bill that will negatively impact courts and defendants.
