On October 13, 2024, a client was bitten by a pit bull. She received significant wounds on her legs as a result of the dog’s vicious and unprovoked attack. The client required 17 stitches to close the wounds that she received. While investigating and researching this case, Weaver Law Injury Attorneys learned that the policy expressly listed and named the pit bull in the homeowner’s insurance policy because it was known to have attacked two people in the past. In addition, the dog’s owner had failed to get the dog its rabies vaccination for well over a year. Despite the pit bull being listed by its name in the homeowner’s insurance policy, the insurance company did everything that it could to deny the claim.

First, the insurance company delayed responding to the demand because it alleges that it could not get in contact with the homeowner – despite being able to accept the homeowner’s checks every month. Next, the insurance company tried to get out from paying its due by making the argument that the failure to obtain a timely rabies vaccination invalidated the insurance policy. Then, when that argument was soundly defeated, it made the last-ditch effort to say that the dog was not properly registered. All the while the insurance company made these hollow attempts to avoid paying for the homeowner’s negligence, it never provided the actual policy language it was relying on to make its failed arguments. The attorneys at Weaver Law Injury Attorneys do not take bad news lightly, and fought against the insurance company’s attempts to deny coverage fervently and were able to defeat its arguments despite the insurance company doing its best to rely on hidden information.

Thanks to the detailed research of our team, all of the insurance company’s arguments were defeated and they were held accountable. We were able to recover the full extent of the homeowner’s policy for the client.
