I've recently written about changes in the rules for registering unpublished works with the Copyright Office. Specifically, only 10 unpublished works can be registered under the same application. A new case in the Ninth Circuit (Gold Value International Textile, Inc. v. Sanctuary Clothing, LLC) provides a harsh lesson regarding the importance of getting the distinction between published and unpublished works correct. In the case, plaintiff brought an infringement claim against defendant but ultimately got stuck having to pay over one hundred thousand dollars of the defendant's attorney fees (not to mention what the plaintiff had to pay its own attorneys) because the plaintiff's copyright registration was found to be invalid. Why? The fabric design at issue was registered with other "unpublished" creations, but that design had actually been provided as samples to potential licensees, which the court found to be a publication. Remember, if you provide, even for free, copies of your creation to third parties, you will likely be found to have "published" your work. It doesn't pay to take your chances to save $35.
