Short answer: not automatically.

In Georgia, property you owned before the marriage is generally considered separate property. But it can become more complicated over time.

If marital money was used to pay the mortgage, make improvements, or maintain the property, your spouse may have a claim to a portion of its value.

The details matter. How the property was handled during the marriage often determines how it’s treated in a divorce.

If you’re unsure where you stand, it’s worth getting clarity before making any decisions.

The "Kind Partner" and the "Abuser" are the same person. The apologies aren't a sign of change—they are part of the cycle. ⚖️

If you’re living in fear or walking on eggshells, you aren't in a "tough spot"—you are in a dangerous one. You don’t have to wait for the next incident to protect yourself and your children.

A Temporary Protective Order (TPO) in Georgia is designed to give you immediate safety, temporary custody, and the space to breathe.

You’ve protected the relationship long enough. It’s time to protect yourself.

Is "five minutes late" becoming your co-parent’s new habit? ⚖️

In Georgia, a court order requires strict compliance. While a one-time delay happens, a documented pattern of tardiness is considered Willful Contempt.

Stop arguing in the driveway and start logging the times. A judge can order the late parent to pay your attorney’s fees and make up for lost time. If the excuses have become the rule, we’re ready to get to work.

Child support doesn’t automatically cover everything.

Private school, tutoring, and enrichment expenses only get included if they’re addressed in the order. If they’re left out, there’s no guarantee either parent has to contribute.

Details like these are where many agreements fall short.

Tax refunds don’t automatically belong to whoever earned more.

If you’re still married and your divorce isn’t final, that refund is often considered marital property in Georgia. Keeping all of it without agreement can create problems with the judge.

Before you cash the check and make a decision you regret, understand how it may be treated in your case.

If you’re taking the kids out of Georgia this Spring Break, whether it's a flight to Spain or a drive to Florida, you likely have a legal "Notice Requirement."

Most Georgia decrees require you to provide a full itinerary (flight numbers, hotel addresses, and emergency contact info) at least 14 days before departure.

Skipping this isn't just a "minor oversight." It’s a technical violation of a court order that your co-parent can use against you later. Keep your vacation drama-free.

Is your ex’s "new friend" already a permanent fixture during parenting time? ⚖️

In Georgia, we often include a Paramour Clause to prevent a "revolving door" of partners during a sensitive transition. This legal boundary ensures that romantic guests aren't spending the night while your children are in the house.

It’s about protecting your kids' environment and maintaining a sense of normalcy. If this boundary is being crossed, the court views it as a violation of a standing order.

Don't let the rules be ignored. Let’s handle the strategy.

In Georgia, adultery can be grounds for divorce.

It can also impact alimony. A spouse who committed adultery may be barred from receiving alimony if the affair caused the separation.

And if marital funds were used to finance that affair, the court can factor that into how assets are divided.
